RECOMMENDATIONS

Staff recommends the Council adopt a resolution approving the summary vacation of a portion of Arthur Avenue between West Herndon Avenue and West Spruce Avenue, as described in Exhibit "A" and as shown on Exhibit "B" of the attached resolution.

EXECUTIVE SUMMARY

Costco Wholesale Corporation is requesting the vacation of a portion of Arthur Avenue between West Herndon Avenue and West Spruce Avenue. The purpose of the vacation is to eliminate excess public street right-of-way that was never developed or constructed to accommodate the development of the Costco Wholesale that will be located at West Herndon Avenue and Riverside Drive in Fresno, California.

BACKGROUND

The proposed vacation is needed to vacate the public street easement that has not been used or paved since the easement was accepted by the County of Fresno and recorded on May 26, 1920, Fresno County Records. This portion of land was annexed into the City of Fresno on December 29, 1981. The adjacent property owner would like to incorporate this excess right-of-way to make way for the development of a Costco Wholesale at the northeast corner of West Herndon Avenue and Riverside Drive in Fresno, California.

The Public Works Department, other City Departments and utility agencies have reviewed this proposal and determined that the street and pedestrian right-of-way proposed for vacation is unnecessary for present or prospective public purposes.
