RECOMMENDATION

Staff recommend City Council approve the First Amendment to the Agreement to extend the term of the Agreement through October 7, 2027, aligning with the grant operation period. This extension will allow the Consultant to continue providing services necessary for the successful completion of the grant funded activities for the Project.

EXECUTIVE SUMMARY

Staff recommend that the City Council approve the First Amendment to the Consultant Services Agreement with the Consultant to extend the term through October 7, 2027. This extension aligns with the grant operation period and ensures continued support for the successful implementation of the Equitable Community Revitalization Grant (ECRG) program and ensures continuity of services and compliance with grant requirements for the Project. This amendment is only an extension in term, not compensation.

BACKGROUND

The California Department of Toxic Substances Control (DTSC) issued an Equitable Community Revitalization Grant (ECRG) Round 2 Guidelines soliciting applications on August 14, 2023, to implement the Cleanup in Vulnerable Communities Initiative under Senate Bill 158 (Chapter 73, Statutes of 2021) allocating $500 million to DTSC to expedite the cleanup and beneficial reuse of contaminated properties, with priority given to properties in historically vulnerable and disadvantaged communities.
