RECOMMENDATION

It is recommended Council adopt the Seventh Amendment to the Fiscal Year 2023 Salary Resolution No. 2022-152 to amend Exhibit 2, effective December 15, 2022.

EXECUTIVE SUMMARY

The City Attorney's Office handles an increasing number of complex personnel investigations required by law. Currently the City Attorney's Office employs one full-time Assistant City Attorney (working title: Special Assistant City Attorney) to conduct personnel investigations. However, the number of requests for investigations outpaces the capacity of a single staff member. The Senior City Attorney Investigator classification will allow the City Attorney's Office to meet demand and comply with legal requirements of conducting prompt personnel investigations.

BACKGROUND

State and federal law requires an employer to conduct a prompt, thorough, and independent administrative investigation wherever there is a complaint of harassment, discrimination, and/or retaliation. This is also required under City of Fresno's Administrative Order 2-16. Legally sufficient investigations require extensive training and mastery of rights of all parties. Such expertise often requires years of experience and/or specialized training.
