RECOMMENDATION

Staff recommends that the City Council approve Tenth Amendment to the California High Speed Rail Authority (CHSRA) Reimbursement Agreement No. HSR 11-29 (the Agreement) to extend the contract term by 12 months to December 31, 2023 and authorize the Public Works Director or his designee to execute the amendment on behalf of the City of Fresno (City).

EXECUTIVE SUMMARY

The Tenth Amendment will extend the term of the Agreement by 12 months, with the new contract end date of December 31, 2023. The amendment will provide for continued reimbursement for the cost of City Staff working on new and existing cooperative agreements and Right of Way functions required for the High-Speed Rail program. Staff will be preparing and reviewing legal descriptions, mapping for Right of Entry, Joint Use Agreements (JUA), Consent for Common Use Agreements (CCUA), Vacations, and dedication packages.

BACKGROUND

On May 3, 2012, City Council approved a Memorandum of Understanding with the CHSRA to develop a series a Cooperative Agreements for the High Speed Rail Project. The CHSRA agreed to reimburse the City for staff cost incurred in developing the Agreements up to $296,000.
