It is recommended the Council adopt the attached resolution dedicating certain City-owned property as an easement for public street purposes.
EXECUTIVE SUMMARY
The City of Fresno Water Division is developing Pump Station No. 250A on the west side of North Effie Avenue north of East Gettysburg Avenue in accordance with Conditional Use Permit No. C-12-127. The Conditions of Approval stipulate that easements are dedicated for public street purposes across the frontage of the site along North Effie Avenue. The dedication of this easement requires City Council approval.
BACKGROUND
The City of Fresno owns property at 4701 North Effie Avenue, located on the west side of North Effie Avenue north of East Gettysburg Avenue (APN 427-171-24T). The property for Pump Station No. 250A was acquired by the City of Fresno by a Grant Deed recorded April 30, 2012 as Document No. 2012-0059660, Official Records of Fresno County. The property is being developed by the City of Fresno's Water Division as Pump Station No. 250A in accordance with Conditional Use Permit No. C-12-127. In order to satisfy the requirements of Conditional Use Permit No. C-12-127, it is necessary to dedicate an easement for public street purposes across the frontage of the site along North Effie Street as described in Exhibit "A" and shown on Exhibit "B of the attached resolution.
Public Works has approved the legal description of the subject easement. The City Attorney's Office has reviewed and approved the attached resolution as to form.
ENVIRONMENTAL FINDINGS
Environmental Assessment (EA) No. C-12-127 was prepared for the construction of Pump Station No. 250A with a finding of Mitigated Negative Declaration that the proposed project will not have a significant effect on the environment. The project was approved on October 12, 2012. A Notice of Determination was filed on December 7, 2012.
LOCAL PREFERENCE
Local preference does not apply because the dedication of city-owned property for public purposes does not involve bidding or contracting.
FISCAL IMPACT
There will be no impact to the City's General Fund because the City's Water Division is funding this Council action.
