Staff recommends the City Council adopt the attached Resolution rescinding and replacing Resolution No. 2009-80 regarding City Policy on the Distribution and Use of the Tickets and Skybox for the Multipurpose Stadium (Chukchansi Park).
 
EXECUTIVE SUMMARY
 
The proposed Resolution reflects the new organizational changes that have taken place within the City. The distribution procedure has been streamlined to make it more flexible.  
 
BACKGROUND
 
Under the terms of the Agreement with Fresno Grizzlies, Inc., concerning the construction and sublease of the multipurpose stadium, the City has use of 12 season tickets within the skybox during the Grizzlies' regular season home games and the tickets are public resources.  Title 2 of the California Code of Regulations section 18944.1 required the City to adopt an official policy regulating the distribution and use of the tickets and skybox provided to the City.  On May 17, 2002, the City Council approved Resolution Number 2002-164 which established "The Official City Policy on the Use of the Tickets and Skybox for the Multipurpose Stadium" so that the use of the tickets and skybox were not considered gifts to the public officials under the Political Reform Act.
 
The Political Reform Act, as amended required the City to revise the City policy by adding the public purposes to be accomplished by the distribution of the tickets, prohibiting the transfer of the tickets, by any official that are distributed to the official under the policy, and adding disclosure and reporting requirements by the City.  Council previously adopted Resolution No. 2009-80, which clarified and established the Grizzlies ticket distribution to comply with the Political Reform Act, as amended.
 
The proposed resolution amends the City Policy on the Distribution and Use of the Tickets and Skybox for the Multipurpose Stadium to reflect new organizational changes, which have taken place within the City and provide a more flexible distribution procedure. Under the proposed resolution, the number of sets of tickets being distributed to the Offices of the Mayor and the seven Councilmembers remains unchanged at seven game days per elected official, however, said tickets may be assigned to the City Manager for distribution at the discretion of the official.  The remaining sixteen (16) days will be assigned and allocated by the City Manager's Office, with consideration to be made for economic development opportunities, non-profit groups, recognition of outstanding employee accomplishments or key individuals as determined by the City Manager.

This is not a project for the purpose of California Environmental Quality Act (CEQA).
 
LOCAL PREFERENCE
 
Local preference does not apply to the adoption of a Resolution.
 
FISCAL IMPACT
 
There is no fiscal impact to the City.
