Actions pertaining to License Agreements for Community Based Organizations Operating Neighborhood Parks

RECOMMENDATION
Staff recommends that the City Council approve the attached agreements for lead agency operation of a neighborhood center with Boys and Girls Club of Fresno County for El Dorado Park, Fresno Economic Opportunities Commission for the Sunset Neighborhood Center, Boys 2 Men, Girls 2 Women for the Pinedale Community Center and United One Productions for the Mary Ella Brown Neighborhood Center.
EXECUTIVE SUMMARY
The attached agreements will extend an existing five year partnership with each Community Based Organization (CBO) for an additional three (3) years to operate the following Neighborhood Centers; Pinedale, Sunset, Mary Ella Brown and El Dorado. This agreement will allow the CBO to continue services in neighborhoods by facilitating and operating each of these centers through 2018. These agreements grant permission to each CBO to utilize the Community Center in exchange for providing social service and recreational programs to the community between the critical hours of 3:00pm - 7:00pm. While each of the recreational programs may look slightly different based on community needs, they will each have the same components of arts and crafts, physical fitness, table games, snacks or sack lunch and homework centers. It is also important to note that each CBO provides social services programs above and beyond the drop in recreational program at each site. These programs are offered prior to the drop in recreational program opening at 3:00pm and or into the evening after the recreational programs conclude. Due to the financial constraints of operating a Community Center and at the request of the CBOs, the PARCS Department has agreed to provide two (2) staff to work collaboratively with each CBO by providing drop in recreational programs at Mary Ella Brown, Sunset and El Dorado Parks. Pinedale will continue to be operated by Boys 2 Men, Girls 2 Women with no additional assistance. If approved, these agreements will continue through July 31, 2018.
BACKGROUND
Effective October 1, 2010 the City of Fresno PARCS Department agreed to terms with several CBOs to operate several neighborhood centers for recreation services throughout the community. These agreements are set to expire on July 31, 2015. The PARCS Department, with council’s approval, requests approval to continue these partnerships through July 31, 2018. The agreements that PARCS is requesting council approval for are El Dorado Park, Mary Ella Brown Community Center, Pinedale Community Center and Sunset Community Center. Currently we have seven (7) sites where CBOs are lead operational agencies: Pinedale, Mary Ella Brown, Mosqueda, El Dorado, Mary Ella Brown, Fink White and Sunset. The four agreements attached for approval are the only ones set to expire on July 31, 2015. It is PARCS desire to continue all CBO partnerships in the future.
The attached agreements were created by the City of Fresno for consideration and approval by the City of Fresno City Council. The contractual agreement for the lead agency would establish a three year commitment. The CBO’s will maintain and operate programs in the building and will have discretion to facilitate programs in partnership with PARCS staff that are operated inside the facility. The buildings and green space around the center will remain the responsibility of the City for maintenance in a manner consistent with the majority of other similar neighborhood parks and center facilities. Enhanced maintenance requested by a CBO above the department’s standard levels of service can be arranged but will be paid for by the CBO. The City will continue to pay for gas, electricity, water, sewer, and garbage; however, if the monthly gas and electricity expense at the Center exceeds 5.00% of the expense for the same quarter in the prior fiscal year, the CBO will be required to reimburse the City for the overage on a quarterly basis.
If a CBO wishes to conduct religious, political, or other activity outside the scope of services outlined in this agreement, those activities are subject to a separate rental agreement with the City. This department will reserve the right to make the Center available for reservations and will confer with the CBO to ensure that Center activities are minimally disrupted.
ENVIRONMENTAL FINDINGS
By definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this item does not qualify as a “project” for the purposes of CEQA.
LOCAL PREFERENCE
Not implemented because this item does not include a bid or award of a construction or service contract.
FISCAL IMPACT
Approval of the attached Agreements will impact the General Fund for FY16. PARCS included an additional funding request of $85,200 for staffing the recreation programs for FY16. Facility maintenance, utilities, and field/landscape maintenance have been budgeted at minimum levels for all neighborhood center sites in FY16. As noted above, gas & electric expenses incurred at the Centers that are more than 5.00% above current levels will be reimbursed to the City.
