RECOMMENDATION

It is recommended that Council approve the attached resolution concerning appointing authority and responsibility.

EXECUTIVE SUMMARY

The attached resolution is intended to clarify, and more importantly, codify the Charter authority granted to the Mayor, City Council, City Attorney, City Manager, and City Clerk.

BACKGROUND

Given last week's discussion related to the authority that is granted to elected and appointed positions pursuant to the Fresno City Charter, the City Attorney and City Manager have drafted the attached resolution that will serve to codify the roles and responsibilities of the Mayor, City Council, City Attorney, City Manager, and City Clerk.

Pursuant to various Fresno City Charter Sections, the Council has the sole authority to appoint the City Attorney and City Clerk. Furthermore, the Council has the authority to appoint and remove Council Assistants. Conversely, pursuant to Charter Sections 400 and 705, the Mayor has the sole authority to appoint and remove the City Manager, who in turn, has the authority to approve or disapprove the appointment and removals of deputies, assistants, and subordinate employees or officers except for the City Attorney and City Clerk.

Therefore, pursuant to Charter Sections 500 and 800, the Councilmembers, City Attorney and City Clerk have the sole authority and responsibility for appointment, removal, corrective action, compensation for subordinate employees under their respected offices. The City Manager retains the sole responsibility for the appointment, removal, and compensation for employees who are not under the purview of the City Council, City Attorney and City Clerk.
