RECOMMENDATION
Staff recommends that the City Council adopt a finding of Categorical Exemption for the Vinland Park Splash Play Area project per staff determination, pursuant to Section 15303(e) of the CEQA Guidelines and award a construction contract to American Construction Engineers of Tollhouse, California, in the amount of $334,950 as the lowest responsive and responsible bidder and authorize the Public Works Director or designee to sign the contract on behalf of the City.
EXECUTIVE SUMMARY
The Vinland Park Splash Play Area project will construct an interactive splash play area. During warmer months, the Splash Play Area will allow children to keep cool and provide safe outdoor recreation opportunities. This project will improve the overall quality of life for local residents and children who visit Vinland Park.
BACKGROUND
Vinland Park is a 6.55 acre neighborhood park located at the intersection of East Gettysburg Avenue and Highway 168. Vinland Park is situated adjacent to many neighborhoods with families. The proposed Splash Play Area Project will construct the splash play area along with the mechanical equipment to filter and treat the recirculated water.
Staff prepared bid documents with a scope that included construction of the splash play area and supply and installation of the related equipment.
A Notice Inviting Bids was published in the Business Journal on November 11, 2015, and posted on the City’s website and faxed to ten (10) building exchanges. The specifications were distributed to fifteen (15) prospective bidders. Eight (8) sealed bid proposals were received and opened in a public bid opening on December 15, 2015. Bids ranged from $334,950 to $434,000. American Construction Engineers, which submitted the bid in the amount of $334,950, was determined to be the lowest responsive and responsible bidder for the project. The bids will expire in 64 days from the bid opening date on December 15, 2015.
Staff is recommending that the Council award a construction contract with American Construction Engineers of Tollhouse, California, in the amount of $334,950 for the Vinland Park Splash Play Area Project, and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.
ENVIRONMENTAL FINDINGS
Staff has determined that a Categorical Exemption is appropriate, based on Class 3 Section 15303e of the CEQA Guidelines, which exempts accessory structures including swimming pools. Furthermore, Staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project. Staff recommends Council, based upon its own independent judgment, adopt finding of a Categorical Exemption per staff determination, pursuant to Section 153031e, Class 3 of the CEQA guidelines for the Vinland Park Splash Play Area Project.
LOCAL PREFERENCE
American Construction Engineers is a local contractor based in Tollhouse, CA.
FISCAL IMPACT
The project is located in Council District 4. The overall cost of the project is $398,950, which is being funded by $75,000 in Parkland Quimby fees and the remainder from the General Fund. The necessary budget appropriations were approved by Council budget actions in June and December 2015. The impact of the new splash play area has been included and considered in the City's budget. Of the overall budget of the project, $334,950 will be used for the construction contract award.
