BILL - (For Introduction) - Adding Section 9-2518 to the Fresno Municipal Code, relating to unlawful criminal street gang activity

RECOMMENDATION

It is recommended the Council adopt the additional section, which would be added to Article 25 of Chapter 9, which pertains to crimes against public decency and good morals.

EXECUTIVE SUMMARY

The proposed section will make it unlawful for gang members to do any of the following acts within 1,000 feet of a school or park: (i) recruit or encourage any person to actively participate in a criminal street gang; (ii) harass or intimidate any person; and (iii) buy, sell, possess, or use any illegal drugs or weapons.

Violation of the proposed section shall be punishable by a fine not to exceed $500, or by imprisonment not to exceed six months, or both.

BACKGROUND

The proposed amendment will make it unlawful for any person who is a member of a criminal street gang to do any of the following acts in any public place that is within 1,000 feet from a school or park:

* Recruit, induce, solicit, intimidate, or encourage any person to: (i) actively participate in any criminal street gang, (ii) participate in any activity designed or intended to further the interests of any criminal street gang, or (iii) participate in any activity or conduct prohibited by this section;
* Harass or intimidate any person; and
* Buy, sell, possess, or use illegal drugs or weapons.

Violation of the chapter shall be punishable by a fine not to exceed $500, or by imprisonment not to exceed six months, or both.

FISCAL IMPACT

There is no direct fiscal impact from passing this ordinance. However, there is a fine assigned in the ordinance which will impact revenues depending upon the number of citations issued...
