Approve a contract change order in the amount of $269,717.81 for the construction contract with Garney Construction of Livermore, California, for the Recycled Water Transmission Main, Southwest Quadrant, Project SW1C (Bid File 3439) (Council District 3 and Fresno County).

Staff recommends the Council approve the contract change order with Garney Construction for the Recycled Water Transmission Main (Main), Southwest Quadrant, Project SW1C (Project).
EXECUTIVE SUMMARY
The Department of Public Utilities, Wastewater Management Division requests the approval of contract change order number 1 for the Project. Due to constraint changes in the project associated with the High Speed Train the recycled water transmission main alignment has been revised to exit Roeding Park at the mid-point in lieu of into the Belmont Avenue loop. This change increases the originally proposed pipeline in the park to 24” diameter from 10” and eliminates the pipeline proposed into the Belmont loop Alignment that would have been installed in the next phase. This contract change order also adds a Caltrans connection and two recycled water truck fill stations to the project. The approval of this $269,717.81 change order will increase the original contract price by 6.4% to a new total of $4,467,892.81.
BACKGROUND
On April 21, 2016, Council approved the construction contract with Garney Construction for the Project. The notice to proceed was issued on May 31, 2016, with a contract completion date of November 2, 2016. On May 3, 2016, revised plans were received for the modifications to the Belmont Avenue Loop realignment. The loop realignment caused the alignment of the Main to become unacceptable because of the depths and limited easement access. Therefore, staff had the design engineer do an emergency redesign that would provide an acceptable, maintainable new alignment. The revised plans were reviewed by the Planning and Development Department for CEQA compliance.
Staff, in conjunction with the Construction Manager, negotiated a revised price for the addition work in the amount of $269,717.81 and no additional days; which includes the Caltrans connection and two truck fill stations.
ENVIRONMENTAL FINDINGS
A Mitigated Negative Declaration (MND) was adopted by the Council on December 18, 2014, for this Project. An analysis has been performed pursuant to CEQA Guidelines §15162 to determine whether subsequent environmental review is required for the Project. Based on this analysis the following findings are made to support the determination that no subsequent environmental review is required:
1. No substantial changes are proposed in the Project which will require major revisions of the previous MND due to the involvement of new significant environmental effects, or a substantial increase in the severity of previously identified significant effects.
2. No substantial changes occur with respect to the circumstances under which the Project is undertaken which will require major revisions of the previous MND due to the involvement of new significant environmental effects, or a substantial increase in the severity of previously identified significant effects.
3. There is no new information which was not known or could not have been known at the time of the previous MND that the Project will have significant effects not discussed in the MND.
Furthermore, since a MND was previously adopted for this Project, the considerations set forth in CEQA Guidelines §15162(a)(3)(C) and (D), related to the adequacy and feasibility of previously adopted mitigation measures, are not applicable. Based upon these findings, it has been determined that no further environmental documentation is required for this Project.
LOCAL PREFERENCE
Local preference was not implemented because this item is the approval of a Change Order.
FISCAL IMPACT
This Project has no impact to the General Fund and is located in Council District 3 and Fresno County. The Clean Water State Revolving Fund (SRF) loan will be repaid from pledged Sewer Enterprise revenues. Funds in the amount of $17,000,000 were budgeted if FY17 and are available in the SRF loan fund.
