RECOMMENDATION

Staff recommends the Council approve a Memorandum of Understanding (MOU) to reimburse The McCaffrey Group, Inc., (Developer) in the amount of $96,065.09 for the construction of a trail along Herndon Avenue.

EXECUTIVE SUMMARY

The McCaffrey Group has developed Tract Map 6052 located at the northwest corner of Herndon and Hayes Avenues. The Conditions of Approval made them responsible for widening Herndon Avenue and constructing a bicycle and pedestrian trail. This trail segment is included in the City's capital project budget and is eligible for reimbursement. Staff recommends approval of the MOU so the reimbursement can be made.

BACKGROUND

The McCaffrey Group has developed Tract Map 6052 located at the northwest corner of Herndon and Hayes Avenues. The map was conditioned to construct an additional westbound lane on Herndon Avenue, as well as the Herndon Avenue trail along the map's frontage. The public trail is approximately 600 feet long, will connect to trails on both sides, and is identified in the Bicycle and Trail Master Plan. This phase of the Herndon Trail is in the adopted City capital budget and is eligible for reimbursement utilizing Measure "C" funds for bicycle and pedestrian trail improvements. Staff has reviewed and approved all submitted costs incurred by the Developer. The MOU has been reviewed and approved as to form by the City Attorney's office.
