RECOMMENDATION

 

Staff recommends the City Council approve a second contract amendment with Carollo Engineers, Inc. to finish construction management services for the Recycled Water Pump Station (Station), associated with the Tertiary Treatment and Disinfection Facility (Facility). 

 

EXECUTIVE SUMMARY

 

Carollo Engineers have been providing the construction management services for the construction of the Facility and the associated Fresno/Clovis Regional Wastewater Reclamation Facility (Regional Facility).  The construction contract completion date was November 21, 2016.  The actual completion date is the middle of January 2017.  The construction management services contract was to end after November 2017.  Because the construction was not completed, the Department of Public Utilities, Wastewater Management Division requests the approval of a second contract amendment with Carollo Engineers, Inc. to provide construction management services for the Facility and Station project beyond the scope of the original agreement.  The amended contract compensation would provide sufficient funds through January.

 

BACKGROUND

On June 26, 2014, Council awarded a construction contract to WM Lyles for the construction of the Facility.  On April 21, 2016, the City Council awarded a construction contract to Clark Bros. Construction Company for the construction of the Station, located at the Regional Facility.  Construction management services were to be provided by Carollo Engineers, Inc., for these two projects with a contract completion date of November 21, 2016.  The construction schedule for the Station was extremely aggressive at only 180 calendar days.  The construction management work for the Facility has continued on well past substantial completion because of the need to perform a second Bioassy test on the Ultraviolet Disinfection System.  This testing was completed the week of January 2, 2017.  In addition to the Facility retesting the Station construction did not finish on schedule.  There are multiple parallel reasons for this failure to complete.  The contractor experienced delays procuring equipment, there were weather delays, and the City initiated change orders.  Final Completion is now scheduled for January 31, 2017.  Carollo has projected their staffing cost through this date to be $95,920, increasing the contract total to $1,928,892.  A second contract amendment is necessary to provide construction management services through the completion of the contract.

 

The City Attorney’s Office has reviewed and approved as to form this Second Amendment to Agreement.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378 the award of this contract does not qualify as a “project” for the purpose of CEQA. 

 

LOCAL PREFERENCE

 

Local preference was not implemented because this is an amendment to an existing consultant services agreement.

 

FISCAL IMPACT

 

This project has no financial impact on the General Fund and is located in Council District 3. Funds for the completion of this construction project are budgeted in FY17 and available in the Sewer Enterprise Fund No. 40501.
