RECOMMENDATION

 

Staff recommends City Council award a construction contract in the amount of $767,815 to Avison Construction, Inc., of Madera, California, as the lowest responsive and responsible bidder for the Herndon Avenue Westbound Auxiliary Lane - State Route 41 to Fresno Street Project and authorize the Public Works Director or designee to sign the contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The City of Fresno seeks to construct the Project located on Herndon Avenue between State Route 41 to Fresno Street.  The proposed Project consists of construction of an additional lane to relieve congestion and reduce delay on Herndon Avenue between Fresno Street and the SR 41 on-ramp.  The work will include widening the road while constructing new curb and gutter, pedestrian facilities and constructing a ten foot multi-purpose trail that will connect to the existing Herndon Trail. The Project will provide improved traffic flow and improve air quality by improving access to the SR 41 on-ramp. The main funding source for the project is a Federal grant through the Regional Surface Transportation Program (RSTP).

 

BACKGROUND

 

On October 15, 2009, the Council adopted a resolution authorizing the submission of applications for and acceptance of funds from the Council of Fresno County Governments (Fresno COG) 2009 Call for Projects. This resolution included a large number of project applications for RSTP funds as well as Congestion Mitigation and Air Quality (CMAQ) program funds. The Herndon Avenue auxiliary lane project from SR-41 to Fresno Street was included in the Council resolution, selected for funding through the Fresno COG process and received RSTP Regional Bid project funding.

 

Public Works Department staff prepared construction contract documents for the Project.  The Project includes construction of an additional westbound lane to relieve congestion and reduce delay on Herndon Avenue between Fresno Street and the SR 41 on-ramp.  The work will include widening the road while constructing new curb and gutter, pedestrian facilities and constructing a ten foot multi-purpose trail that will connect to the existing Herndon Trail. 

 

On October 12, 2016, a Notice Inviting Bids was posted on the City’s website and faxed to ten (10) building exchanges.  Construction contract documents were distributed to forty-seven (47) prospective bidders.  Three sealed bids were received and opened in the public bid opening on November 8, 2016.  The total bid proposal prices ranged from $767,815 to $902,662.

 

Avison Construction, Inc. submitted the bid in the amount of $767,815, for the Project.  The bid is 29% above the Project’s Engineers Estimate and is considered a responsive and responsible bid.  The staff determination was posted on the City’s website site on November 9, 2016.

 

Staff recommends City Council award a construction contract for $767,815 to Avison Construction, Inc. as the lowest responsive and responsible bidder for the Herndon Avenue Westbound Auxiliary Lane - State Route 41 to Fresno Street Project and authorize the Public Works Director or assignee to sign the contract on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

An Initial Study and Finding of Conformity to the MEIR No. 10130 MND Air Quality prepared for the General Plan were adopted by the Council on October 29, 2015.  An analysis has been performed pursuant to CEQA Guidelines §15162 to determine whether subsequent environmental review is required for the Project. Based on this analysis the following findings are made to support the determination that no subsequent environmental review is required:

 

1.                     No substantial changes are proposed in the Project which will require major revisions of the previous addenda to the Initial Study Findings of Conformity due to the involvement of new significant environmental effects, or a substantial increase in the severity of previously identified significant effects.

 

2.                     No substantial changes occur with respect to the circumstances under which the Project is undertaken which will require major revisions of the previous addenda to the Initial Study Findings of Conformity due to the involvement of new significant environmental effects, or a substantial increase in the severity of previously identified significant effects.

 

There is no new information which was not known or could not have been known at the time of the previous finding of conformity that the Project will have significant effects not discussed in the addenda to the Initial Study Findings of Conformity. Furthermore, since a Finding of Conformity to the MEIR was previously adopted for this Project, the considerations set forth in CEQA Guidelines §15162(a)(3)(C) and (D), related to the adequacy and feasibility of previously adopted mitigation measures, are not applicable. Based upon these findings, it has been determined that no further environmental documentation is required for this Project. 

 

LOCAL PREFERENCE

 

The local preference was not implemented due to restrictions associated with the Federal grant funds for the project.

 

FISCAL IMPACT

 

The Project is located in Council District 6. The overall budget for the Project is $1,418,100 and is funded by $1,229,600 from Federal RSTP funds, $140,200 from Measure C - Trails and $48,300 from Proposition 111 Special Gas Tax.  The Project will not have any impact to the General Fund.  Of the overall budget of the Project, $767,815 will be used for the construction contract award.
