Title
Approve a License Agreement between the City of Fresno and Fresno Unified School District for the construction and maintenance of the Fairview Trail (Council District 3).

RECOMMENDATION
Staff recommends that the City Council approve the License Agreement between the City of Fresno and Fresno Unified School District (FUSD) for the construction and maintenance of the Fairview Trail and allow the Public Works Director or designee to sign on behalf of the City.
EXECUTIVE SUMMARY
The Fairview Trail, which is currently in disrepair, lies on FUSD property adjacent to Edison High School in Southwest Fresno. The City has a project budgeted to rebuild the trail this Summer 2017. The License Agreement will allow the construction to occur and outlines the responsibility for future maintenance of the trail.
BACKGROUND
The Fairview Trail, which runs along the east side of Edison High School and the northern edge of a City park is currently in disrepair. The trail has deteriorated and the lighting system is not functional. The scope of the project is to reconstruct the trail and install new lighting.
The License Agreement between the City of Fresno and Fresno Unified School District will allow for a construction contract to be let by the City of Fresno to rebuild the trail. The Agreement also outlines the future responsibilities of maintenance. The City of Fresno plans to maintain the trail and lighting while FUSD will maintain the adjacent landscaping and irrigation.
