Authorize City Manager to enter into the attached "Reimbursement Agreement, California High Speed Rail Heavy Maintenance Facility" with the Fresno County Transportation Authority

RECOMMENDATION
It is recommended by staff that the City Council authorize the City Manager to enter into the attached REIMBURSEMENT AGREEMENT with the Fresno County Transportation Authority to receive reimbursement from Measure C transportation funds for the non-refundable deposits the City will incur while entering into the Agreements for Purchase and Sale of Property for the purpose of assembling the necessary land needed to be competitive for the location of the proposed California High Speed Rail Authority's ("CHSRAs") Heavy Maintenance Facility (HMF) at the Fresno site.
EXECUTIVE SUMMARY
On October 13, 2016, the Council authorized the City Manager to enter into conditional purchase and sales agreements to acquire properties within the proposed Fresno High Speed Rail HMF footprint which would allow the City to control the property for 12 months, and up to two years, through a non-refundable deposit(s) for a total amount not to exceed $250,000 per year. The second part of that Council action was to authorize the City Manager to pursue a reimbursement agreement for the cost of those agreements from the $25 million in Measure C funds already allocated by the Fresno County Transportation Authority for the Fresno HMF. Since that Council authorization, the City Manager has received approval for reimbursement from the Measure C funds from the Fresno Council of Governments on January 26, 2017 (Resolution 2017-01) and, subsequently, on February 8, 2017 the Fresno County Transportation Authority approved the amendment to the Measure C expenditure plan to allow for the reimbursement and to give the Executive Director authority ...
