Title
RESOLUTION - Dedicating certain city-owned property as an easement for water main purposes located on Outlot D of Tract 5935 (Council District 4).

RECOMMENDATION
Staff recommends the City Council adopt the attached resolution ordering the dedication of a water line easement, in the area of Outlot “D” of Tract 5935, as described in Exhibit “A” and shown in Exhibit “B” of the attached resolution.
EXECUTIVE SUMMARY
The proposed dedication is needed to accommodate the requirement for two independent water sources for Tentative Tract 5971. The Public Works Department seeks dedication to fulfill this requirement. Prior to any construction on Outlot “D”, a neighborhood meeting will be held to discuss the upcoming construction.
BACKGROUND
The proposed dedication described in Exhibit “A” and shown in Exhibit “B” of the attached resolution is needed to accommodate the construction of a water line easement, which is required as a condition of development for Tentative Tract 5971.
The Traffic and Engineering Services Division, other City departments and utility agencies have reviewed the proposed dedication and determined that the easement is adequate to accommodate the requirement for two independent water sources for Tentative Tract 5971.
The City Attorney’s Office has approved the attached Resolution as to form.
ENVIRONMENTAL FINDINGS
This project is exempt under Sections 15301/Class 1 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. A-10-06/R-10-06/T-5971. Under the Section 15301/Class 1 exemption, the minor alteration of existing public facilities, such as streets, sidewalks, etc., involving no expansion of use beyond that existing at this time, are exempt from CEQA requirements. The proposed dedication of City owned property for a water line easement purposes meets the criteria noted above. No significant effects would occur as a result of the proposed project. Therefore, the above described project complies with the conditions described in Section 15301/Class 1 of the CEQA Guidelines. None of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines Section 15300.2 apply to this project.
LOCAL PREFERENCE
Local preference does not apply because the dedication of a water line easement at this location does not involve bidding or contracting.
FISCAL IMPACT
This item will not impact the General Fund.
