RECOMMENDATIONS

 

Staff recommends that Council adopt the 52nd Amendment to the Annual Appropriation Resolution (AAR) No. 2016-118, adopt a finding of a Categorical Exemption, grant relief to BC Construction and award a construction contract with Divcon, Inc., for $742,039 for the Fire Station No. 20 Remodel project and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The Fig Garden Fire Protection District has been serving the area since Fire Station No. 20 was built in 1942.  The station is in desperate need of upgrades to allow firefighters to perform their duties in a much more safe and efficient manner.    This construction contract with Divcon, Inc., will allow Fire Station No. 20 to be brought up to current Fire department standards as much as possible.

 

BACKGROUND

 

Fire Station No. 20 was built in 1942 and is in desperate need of upgrades to allow Fire personnel to perform their duties in a much more safe and efficient manner.  There have been additions and modifications made to the station throughout its history which are now incompatible with daily activities and duties of the firefighters. 

 

Fire Department staff entered into an agreement for consultant services on behalf of the City of Fresno for the design and preparation of construction documents for the Fire Station No. 20 remodel project.

 

Plans and specifications were prepared by Dale Rutherford Architecture.  A Notice Inviting Bids was published on February 22, 2017, distributed to ten building exchanges and posted on the City’s website.  The specifications were distributed to eight prospective bidders.  Five sealed bid proposals were received and opened in a public bid opening on March 7, 2017, with the bid amounts ranging from $426,664 to $759,500. 

 

The apparent low bidder, BC Construction & Electric, submitted a request to withdraw their bid in accordance with Public Contract Code 5103.  The bidder mistakenly left off two major components of the project in their bid, making their bid materially different than intended.  The mistake was made in filling out the bid and not due to error in judgment.

 

Staff is recommending that Council adopt the 52nd Amendment to the AAR No. 2016-118, adopt finding of a Categorical Exemption, grant BC Construction & Electric relief from their bid and award the construction contract to Divcon, Inc., of Clovis, CA, for $742,039 for the Fire Station No. 20 Remodel and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno. 

 

ENVIRONMENTAL FINDINGS

 

Staff has determined that a Categorical Exemption is appropriate, based on Class 1 Section 15301(a) of the CEQA Guidelines, which exempts interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances.  Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.  Staff recommends that the Council, based upon its own independent judgment, adopt a finding of a Categorical Exemption per Staff determination, pursuant to Section 15301(a), Class 1 of the CEQA Guidelines for the Fire Station No. 20 Remodel Project.

 

LOCAL PREFERENCE

 

Local preference was not utilized as the apparent low bidder, after the release of BC Construction’s bid, is a local business.

 

FISCAL IMPACT

 

The Fire Station No. 20 Remodel project is being fully funded by the Fig Garden Fire Protection District; no General Funds will be used.
