RECOMMENDATION

 

Staff recommends that the City Council adopt a finding of a Categorical Exemption per staff determination, pursuant to Section 15301(c) of the CEQA Guidelines and award a construction contract to Emmett's Excavation Inc. of Fresno, California in the amount of $1,755,995 as the lowest responsive and responsible bidder for the Bullard Avenue Overlay, Marks Avenue to Blackstone Avenue project and authorize the Public Works Director or designee to sign the standardized contract on behalf of the City.

 

EXECUTIVE SUMMARY

 

The Bullard Avenue Overlay, Marks Avenue to Blackstone Avenue project will overlay and slurry seal portions of Bullard Avenue, in order to extend the life of this heavily used arterial.  The project will also bring curb ramps up to current standards and achieve compliance with the Americans with Disabilities Act (ADA). Funding for the project is coming from a Federal transportation grant, Fresno County road funds, General Fund dollars and Measure “C” Street Maintenance funds. Awarding of the contract will allow for the majority of the work to be completed during Summer 2017.

 

BACKGROUND

 

Bullard Avenue between Marks Avenue and Blackstone Avenue is a heavily used arterial street that is suffering from pavement deterioration.  The proposed overlay project is a joint project between City of Fresno and the County of Fresno and will extend the service life of the street and bring affected curb ramps up to current ADA standards. 

 

On October 11, 2016, the City of Fresno entered into an agreement with the County of Fresno for the City to design and construct the Bullard Avenue Overlay, Marks Avenue to Blackstone Avenue project.  The agreement identifies financial and administration obligations of both parties and sets thresholds for costs based on an attached engineer's cost estimate.     

 

Staff prepared bid documents with a scope that included a 0.20' asphalt overlay, slurry seal, concrete repair and striping.  Additionally, the project will make median island and lane repairs from North Glenn Avenue to a point 280' to the east.

 

The Notice Inviting Bids was published in the Business Journal on April 21, 2017, posted on the City’s website and faxed to ten (10) building exchanges. The specifications were distributed to nine (9) prospective bidders.  Eight (8) sealed bid proposals were received and opened in a public bid opening on May 16, 2017. Bids ranged from $1,755,995 to $2,347,333. Emmett's Excavation Inc. which submitted the bid in the amount of $1,755,995 was determined to be the lowest responsive and responsible bidder for the project. 

 

Staff is recommending that the Council award a construction contract to Emmett's Excavation Inc. of Fresno in the amount of $1,755,995 for the Bullard Avenue Overlay, Marks Avenue to Blackstone Avenue project and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

Staff performed a preliminary environmental assessment of this project and has determined that it falls within the Categorical Exemption set forth in CEQA Guidelines, Section 15301 (c) Class 1 which exempts the repair and maintenance of existing facilities that involves negligible or no expansion of an existing use.  This exemption applies because this project involves the resurfacing of an existing roadway and does not involve the expansion of the roadway to accommodate additional traffic.  The purpose of the project is to increase the life of the pavement and provide a smooth riding surface for the motorists.  Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.

 

LOCAL PREFERENCE

 

The local preference was not implemented based on conditions of the Federal Regional Surface Transportation Program (RSTP) grant.

 

FISCAL IMPACT

 

The Bullard Avenue Overlay, Marks Avenue to Blackstone Avenue project is located in Council District 2 and the County of Fresno. The overall cost of the project is $2,144,992.  The City's portion is $1,523,584 and is funded by RSTP Lifeline, General Fund and Measure “C” Street Maintenance funds.  The County of Fresno's share of construction is $621,407.  As per the agreement, the County's total cost may be adjusted if necessary to reflect actual cost.  All funding necessary for the project, including construction contingency, were included in the adopted City budget. Of the overall budget of the project, $1,755,995 will be used for the construction contract award.
