RECOMMENDATION

 

Staff recommends that the City Council adopt a finding of Categorical Exemption pursuant to Section 15301(c) of the CEQA guidelines, award a construction contract with Agee Construction Corporation of Clovis, California (Agee) in the amount of $640,585 as the lowest responsive and responsible bidder and authorize the Public Works Director or designee to sign the construction contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

Blackstone Avenue pavement from Shields Avenue to Dakota Avenue is in a state of disrepair. The proposed asphalt overlay will correct the existing deteriorated pavement condition and increase the life of the pavement while providing a smooth riding surface for motorists.  Upgrading the curb ramps within project limits to current standards is also in the scope of this project.

 

BACKGROUND

 

The scope of the project includes grinding existing asphalt, providing an asphalt pavement overlay, reconstructing curb ramps to comply with the Americans with Disabilities Act, replacement of damaged traffic detector loops and pavement striping. Public Works Department staff prepared general construction documents for the project.

 

A Notice Inviting Bids which was published in the Fresno Business Journal on May 24, 2017, posted on the City’s website and faxed to thirteen (13) building exchanges. The specifications were distributed to nine (9) prospective bidders.  Six (6) sealed bid proposals were received and opened in a public bid opening on June 27, 2017.  Bids ranged from $640,585 to $722,610. AS Dezign, Inc. submitted the apparent low bid ($613,097.02), but was determined non-responsive for not filling in the Bid Proposal Form Dollar Amount.  Agee submitted a bid in the amount of $640,585 and was determined to be the lowest responsive and responsible bidder for the project.  The bids will expire on August 30, 2017.

 

Staff recommends Council award a construction contract with Agee in the amount of $640,585 for the Blackstone Avenue Pavement Overlay from Shields to Dakota Avenues as the second lowest responsive and responsible bidder, and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

Staff performed a preliminary environmental assessment of this project and determined that it falls within the Categorical Exemption set forth in CEQA Guidelines, Section 15301(c) Class 1 which exempts the repair and maintenance of existing facilities that involves negligible or no expansion of an existing use.  This exemption applies because this project involves the reconstruction of an existing roadway and does not involve the expansion of the roadway to accommodate additional traffic.  The purpose of the project is to replace the surface pavement and provide a smooth riding surface for the motorists.  Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.

 

LOCAL PREFERENCE

 

Local preference was not implemented due to conditions of the Federal grant funding.

 

FISCAL IMPACT

 

The Blackstone Avenue Pavement Overlay from Shields Avenue to Dakota Avenue is located in Council District 7.  The overall cost of the project is $828,500. The project is fully funded with Federal Regional Surface Transportation Lifeline funds (RSTP). All funding necessary for the project, including construction contingency, is included in the adopted City budget. Of the overall budget of the project, $640,585 will be used for the construction contract award.
