Approve a Cooperative Agreement with the County of Fresno for the Orange Avenue Overlay between California and Jensen Avenues, for an estimated City contribution in the amount of $632,424 (Council District 5 and County of Fresno)

RECOMMENDATIONS
Staff recommends Council take the following actions:
1. Approve a Cooperative Agreement with the County of Fresno for the Orange Avenue Overlay from California to Jensen Avenues.
2. Authorize the Public Works Director, or designee, to execute the Cooperative Agreement on behalf of the City.
EXECUTIVE SUMMARY
The Orange Avenue Overlay project between California and Jensen Avenues is part of the City’s adopted budget. As a joint project with the County, a cooperative agreement between the two agencies is required. Staff has developed a Cooperative Agreement with the County of Fresno for the Orange Avenue Overlay between California and Jensen Avenues. Within this area, Orange Avenue is 51% County of Fresno jurisdiction and 49% City of Fresno jurisdiction. The project will consist of a 0.20’ pavement overlay in both the City and County areas of Orange Avenue. The project is scheduled to be advertised for construction bids in the next 30 days with construction to start in July 2018.
BACKGROUND
The City of Fresno Public Works Department and County of Fresno Department of Public Works and Planning are proposing a joint project to overlay Orange Avenue between California and Jensen Avenues. Forty-nine percent of this stretch of Orange Avenue lies within the City of Fresno while the remainder lies within the County of Fresno.
The work will consist of a deep grind of the existing asphalt, a 0.2 foot asphalt concrete overlay, construction of ADA accessible curb ramps, and signing and striping.
The City of Fresno is preparing the plans and specifications for construction and intends to advertise in April 2018. Staff anticipates starting construction in July 2018.
Staff is recommending that the City Council approve the attached Cooperative Agreement with the County of Fresno and authorize the Public Works Director, or designee, to execute the Cooperative Agreement on behalf of the City. The proposed Cooperative Agreement is similar to one previously executed for a stretch of Bullard Avenue.
The City Attorney’s Office has reviewed and approved as to form the proposed agreement.
ENVIRONMENTAL FINDINGS
By the definition provided by the California Environmental Quality Act (CEQA) Guidelines Section 15378, this agreement does not qualify as a “project” for the purposes of CEQA.
LOCAL PREFERENCE
Local Preference was not utilized because this item does not involve an award of construction or requirements contract.
FISCAL IMPACT
The Orange Avenue Overlay from California to Jensen Avenue is located in Council District 5 and the County of Fresno. The City’s portion estimated to be $632,424 is funded by Federal Regional Surface Transportation Program (RSTP) Funds which are appropriated in the FY 2018 Public Works adopted capital budget.
