RECOMMENDATION

It is recommended that Council approve the introduction of the ordinance relating to amendments to Sections 10-1505 Definitions, 10-1507 Prohibited Acts, and 10-55602.4 General Prohibition Against Possession, Sale, Use, and/or Display of Fireworks.

EXECUTIVE SUMMARY

It has come to staff's attention that certain subsections of the Fresno Municipal Code Section 10-1505, 10-1507, and 10-55602.4 reference obsolete code section numbers that were previously repealed by ordinance 2016-48. The proposed ordinance cleans up these obsolete references and adds the correct references. Staff is introducing the attached ordinance to be considered for adoption.

BACKGROUND

Every three years, the California Building Standards Code (CBSC) is reviewed (and modified where applicable) then adopted by the California Building Standards Commission. In 2016, the Commission voted to adopt the 2016 edition of the CBSC which includes the 2016 edition of the California Fire Code. The CBSC went into effect January 1, 2017. The City of Fresno Municipal Code contains these standards which were adopted by Ordinance 2016-48, effective January 9, 2017, which repealed and added Section 10, Article 5, Fire Prevention. The proposed ordinance has been approved by the City Attorney's office.
