Staff recommends that the City Council approve the 545th Amendment to the MFS Resolution
80-420 to add a Notice of Intent to Circulate Petition Fee to the General Government Section of the Master Fee Schedule (MFS).
EXECUTIVE SUMMARY
The Office of the City Clerk is recommending that a fee for filing a notice of intent to circulate an initiative petition be added to the Master Fee Schedule in accordance with requirements set forth in the California Elections Code.
BACKGROUND
Elections Code, Section 9202 (b) states “Any person filing a notice of intent with the elections official shall pay a fee to be established by the legislative body not to exceed two hundred dollars ($200) to be refunded to the filer if, within one year of the date of filing the notice of intent, the elections official certifies the sufficiency of the petition.”
Adding the proposed fee for filing a notice of intent to circulate an initiative petition will put the City in compliance of the Election Code.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this item is not a project and is therefore exempt from CEQA requirements.
LOCAL PREFERENCE
This item does not involve a competitive bid therefore local preference is not applicable.
FISCAL IMPACT
Approval of the proposed fee will likely have no impact on the General Fund as the fee is minimal and refundable within one year
