1.                     Authorize the Chief of Police to enter into an agreement with Fresno Unified School District to provide eleven student resource officers at 100% of the actual officers’ cost, a police sergeant at 90% of the actual sergeant’s cost, plus administrative fees and the patrol vehicle lease costs of twelve patrol vehicles for an annual total of $1,725,941.

RECOMMENDATIONS

 

It is recommended that Council authorize the Chief of Police to enter into an agreement with Fresno Unified School District to provide eleven school resource officers at 100% of the actual officer’s cost, a police sergeant at 90% of the actual sergeant’s cost, plus administrative fees and the lease-financing of twelve patrol vehicles for a total annual payment to City of $1,725,941.

EXECUTIVE SUMMARY 

 

The Fresno Unified School District (FUSD), in an effort to provide a safe learning environment for students attending district high schools and middle schools, has agreed to fund eleven Student Resource Officers (SRO) at 100% and one Sergeant at 90% of the Police Department’s actual rates from July 1, 2018 to June 30, 2021. 

 

FUSD and the Police Department have had a continuous agreement in place since 1995.

 

FUSD will fund $1,595,991 for eleven officers and 10% of a police sergeant plus $350.00 for administrative fees and $129,600 for annual lease payments of twelve patrol vehicles.  The total annual cost is $1,725,941.  The remaining 10% if the police sergeant costs are paid by other contracted school districts.

 

The eleven SROs will perform regular duty law enforcement services.  Ten SRO will be assigned to the district’s high schools (Edison, Roosevelt, Fresno, McLane, Phoenix Secondary, Hoover, Sunnyside, Cambridge, Bullard) located in Fresno. The other SRO is assigned to Fort Miller middle school located in Fresno.  Assignment is during the standard school year and normal hours of operation; subject to the availability of the SRO.  For purposes of the attached agreement, “availability” shall be at the sole determination of the Chief of Police, or designated representative, taking into consideration any factors including, without limitation, health of officer, shortage of manpower, funding, and duty assignment of officer(s) to higher priority matters.  However, in specific instances of the SRO taking personal leave or FPD approved law enforcement training; another available police officer will be assigned temporarily at the schools during such leave or training.

 

The Fresno County Superintendent of Schools (FCSS), in an effort to provide a safe learning environment for students attending district high school has agreed to fund one Student Resource Officer at 100% of the Police Department’s actual rates from July 1, 2018 to June 30, 2021. 

 

FCSS and the Police Department have had a continuous agreement in place since 2005.

 

FCSS will fund $132,353 for one officers and $350.00 for administrative fees and $10,800 for annual lease payments of one patrol vehicle.  The total annual cost is $143,503. 

 

The SR will perform regular duty law enforcement services.  The SRO will be assigned to Violet Heintz Educational Academy, 4939 E. Yale in Fresno.  Assignment is during the standard school year and normal hours of operation; subject to the availability of the SRO.  For purposes of the attached agreement, “availability” shall be at  the sole determination of the Chief of Police, or his/her designated representative, taking into consideration any factors including, without limitation, health of officer, shortage of manpower, funding, and duty assignment of officer(s) to higher priority matters.  However, in specific instances of the SRO taking personal leave or FPD approved law enforcement training; another available police officer will be assigned temporarily at the schools during such leave or training.

 

The City of Fresno intends to finance the 13 vehicles that will be used for the SRO Program through its Master Equipment Lease Purchase Agreement with Banc of America. The annual lease payment of each vehicle will be $10,800.

 

BACKGROUND

 

In August of 1993, the Police Department and FUSD established a Memorandum Of Understanding to have a Student Resource Officer Program at local area High Schools. The success of the Student Resource Officer Program showed that students can build trust relationships with law enforcement officials where officers participate in mentoring, counseling and restorative justice practices at school sites. 

 

The focus area of this partnership is improving safety for children attending each high school in the City of Fresno. These areas contain predominantly non-owner occupancies, with many of the residents living below the poverty level.  Common risk factors include lack of education, uninvolved parents, missing economic opportunities, and an overall void in resources, which create a fertile field for gang membership and drug involvement in and around many of these school sites. 

 

The City Attorney’s Office has reviewed and approved as to form the proposed Fourth Amendment to PAR No. 2017-166.

 

ENVIRONMENTAL FINDINGS:

 

This is not a “project” for the purposes of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378.

 

LOCAL PREFERENCE:

 

Local Preference was not considered because accepting funding does not include a bid or award of a construction or services contract.

 

FISCAL IMPACT

 

FUSD will fund 100% of the Fresno Police Department's operational costs for the period of July 1, 2018 to June 30, 2021.  Operational costs include the eleven police officers and one Sergeant, administrative fees, and the lease/operations/maintenance for twelve patrol vehicles. 

 

FCSS will fund 100% of the Fresno Police Department's operational costs for the period of July 1, 2018 to June 30, 2021.  Operational costs include the police officer, administrative fees, and the lease/operations/maintenance for one patrol vehicles
