RECOMMENDATION

 

Staff recommends that the City Council adopt a finding of Categorical Exemption pursuant to Section 15301(c) Class 1 of the California Environmental Quality Act (CEQA) guidelines, award a construction contract with Dave Christian Construction Inc. of Fresno, California in the amount of $365,331.05 as the lowest responsive and responsible bidder and authorize the Public Works Director or designee to sign the construction contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The City of Fresno seeks to resurface Clinton Avenue from Blackstone Avenue to Maroa Avenue.  The scope of work includes an asphalt pavement grind and overlay, striping and pavement markings, replacement of traffic loop detectors, minor concrete improvements and modifications of curb ramps to meet Americans with Disabilities Act (ADA) compliance.  Awarding a construction contract for this overlay project will increase the lifespan of the roadway and maintain the road’s level of service.  The project is being funded by a Federal grant from the Regional Surface Transportation Program (RSTP) and State funding from the SB1 Gas Tax.

 

BACKGROUND

 

Clinton Avenue from Blackstone Avenue to Maroa Avenue is a heavily used collector street that is suffering from pavement deterioration. The roadway pavement is in poor condition and if no action is taken to maintain the roadway, deterioration will accelerate.  A pavement overlay will increase the lifespan of the roadway and maintain the road’s level of service.  The project includes an asphalt pavement grind and overlay, striping and pavement markings, replacement of traffic loop detectors, minor concrete improvements and modifications of curb ramps to meet ADA compliance.

 

The Clinton Avenue overlay project, from Blackstone Avenue to Maroa Avenue, was initiated in FY16 when the City was awarded a Federal grant from the Regional Surface Transportation Program (RSTP).  The grant funds were obligated and the project was budgeted in the adopted FY17 Capital Budget by City Council.  The preliminary engineering design was initiated following the execution of the consultant contract with Blair, Church & Flynn Consulting Engineers on November 1, 2016.  The preliminary engineering design took approximately 16 months to complete.

 

The area adjacent to the BNSF railroad tracks is being upgraded with Railway-Highway Crossing (Section 130) Program funds and is excluded from the limits of work proposed with the Clinton Avenue overlay project.

 

The Notice Inviting Bids was advertised published in the Business Journal on April 6, 2018, posted on the City’s website and was sent via fax to nine (9) building exchanges.  The specifications were distributed to thirty-nine (39) prospective bidders.  Three (3) sealed bid proposals were received and opened in a public bid opening on May 1, 2018, with the bids ranging from $365,331.05 to $467,055.00.  Dave Christian Construction Inc., is deemed the lowest responsive and responsible bidder.  The apparent low bid price was 12% below the Engineer’s Estimate.  The project will be completed 50 working days after the issuance of the notice to proceed.  The bids will expire in 64 days of the bid opening on July 4, 2018.  If the bids are rejected, the project will be rebid resulting in a delay of approximately 60 days.

 

Staff is recommending award of a construction contract to Dave Christian Construction Inc. in the amount of $365,331.05, to construct a pavement overlay on Clinton Avenue from Blackstone Avenue to Maroa Avenue and to authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

Staff performed a preliminary environmental assessment of this project and has determined that it falls within the Categorical Exemption set forth in CEQA Guidelines, Section 15301 (c) Class 1 which exempts the repair and maintenance of existing facilities that involves negligible or no expansion of an existing use.  This exemption applies because this project involves the resurfacing of an existing roadway and does not involve the expansion of the roadway to accommodate additional traffic.  The purpose of the project is to increase the life of the pavement and provide a smooth riding surface for the motorists.  Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.

 

LOCAL PREFERENCE

 

The local preference was not implemented based on grant funding requirements of the Federal Regional Surface Transportation Program.

 

FISCAL IMPACT

 

The Clinton Avenue AC Overlay from Blackstone to Maroa Avenues is located in Council Districts 1 and 7. The overall cost of the project is $531,811 and is funded by a Federal grant from the Regional Surface Transportation Program (RSTP) and SB1 Gas Tax being the funding source for local match. The project will have no impact to the General Fund. Of the overall budget of the project, $364,331.05 will be used for the construction contract award.
