Staff recommends the City Council adopt a resolution rescinding and replacing Resolution No. 2017-146 regarding granting authority to the City Manager or his or her designee to enter into routine parking agreements for bulk monthly parking contracts for 50 stalls or more

 

EXECUTIVE SUMMARY

 

The City has been working with various agencies to update agreements to implement the parking rates approved by City Council in January of 2017. As part of this process, a Master Bulk Rate Parking Agreement (Agreement) was drafted for agencies that qualified for the flat rate fee of $60.00 per stall per month for 50 stalls or more. Since then, the City has received requests for changes to the Agreement in order to provide for termination clause as well as other clarifying language. The proposed revision to the Agreement has been modified to include the aforementioned requests.

 

BACKGROUND

 

The City of Fresno currently operates parking garages, parking lots, and approximately 1,900 parking meters in downtown.  Parking is provided to the public as well as multiple federal, state, and local agencies and businesses at contracted rates. In January of 2017, the City Council approved changes to the Master Fee Schedule (MFS) which implemented a flat rate fee of $60.00 per stall per month for bulk parking agreements for 50 stalls or more. The City has been working with the varying agencies to implement the new rates. In June of 2017, Council adopted Resolution 2017-146, granting the City Manager or designee the authority to approve agreements that align with the MFS rates and substantially conform to the Agreement. Since adopting the Agreement, the City has received multiple requests from potential licensees to modify the Agreement to include mutual termination provisions, a process for relocation and closure of garages and lots, and other minor clarifying language. Staff recommends Council rescind Resolution 2017-146 and adopt this resolution granting the City Manager or designee the authority to enter into routine parking agreements that align with the MFS rates and with the attached revised Agreement. Any parking agreement which materially deviates from the Agreement will be presented to Council for consideration.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” and is therefore not subject to California Environmental Quality Act requirements.

 

LOCAL PREFERENCE

 

Local preference was not considered because this item does not involve the bid process or the award of a construction or services contract.

 

FISCAL IMPACT

 

The delegation of this authority will have no impact to the General Fund
