RECOMMENDATIONs

 

1.                     Approve the attached Reimbursement Cooperative Agreement between the City of Fresno (the City) and PG&E up to the amount of $415,000 to cover expenses incurred by PG&E resulting from the design review and construction oversight of the realignment of “G” Street between East California Avenue and Santa Clara Street.

2.                     Authorize the Public Works Director or his designee to sign an amendment up to a maximum amount of $415,000 for design review and construction oversight. The agreement has been approved to form by the City’s Attorney Office.

                     

EXECUTIVE SUMMARY

 

Pursuant to the “G” Street Reimbursement Cooperative Agreement between the City and the California High Speed Rail Authority (CHSRA), the City is overseeing a two-phase project to relocate and realign “G” Street in Downtown Fresno. Part of the project requires the City to relocate all utilities in the project boundary - including PG&E’s gas and electric lines. Such relocation will require PG&E involvement and the City will need PG&E to perform design review and approval of existing infrastructure relocation and will need PG&E to provide oversight for the relocation of gas and electrical utilities during construction.  This agreement sets out the terms of the work to be performed by PG&E and the associated compensation. 

 

BACKGROUND

 

As part of the larger California High Speed Rail Project, the City agreed to realign “G” Street to accommodate the Fresno Rescue Mission’s new location.  On September 22, 2016, the Council approved a Reimbursement Cooperative Agreement between the CHSRA and the City (the Cooperative Agreement). Among other items, the Cooperative Agreement requires the City to relocate all utilities that conflict with the construction of the new “G” Street alignment along that portion of “G” Street between East California Avenue and Santa Clara Street so that services provided by the affected utilities are not interrupted. PG&E gas and electric infrastructure is part of the utilities that must be relocated.

 

Because of the nature of the work to be performed, PG&E requires that their staff reviews and approve relocation plans for their infrastructure.  Furthermore, PG&E requires that it have oversight of the pertinent realignment work to be performed.  In consideration for PG&E’s undertakings the City will reimburse PG&E up to $415,000 for design review and construction oversight for the utility relocations being performed, with a contingency of up to $415,000.  The proposed agreement with PG&E sets forth the terms of the services to be provided by PG&E will be on time and material basis and actual cost.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act (CEQA) guidelines, this item is not a project for the purposes of CEQA

 

LOCAL PREFERENCE

 

Not applicable because this is not a competitive bid award.

 

FISCAL IMPACT

 

There will be no impact to the General Fund or any City operating funds associated with the recommended action. All PG&E costs for services provided under this agreement will be paid for by the California High Speed Rail Authority under the current CHSRA and City Cooperative Agreement. The cost of this agreement has been included in the current fiscal year City budget.
