Actions pertaining to the Shields Avenue Overlay, project from Sunnyside Avenue to Fowler Avenue - Bid File 3557-12183 (Council District 4)
1. Adopt a finding of a Categorical Exemption per staff’s determination, pursuant to Section 15301(c) of the California Environmental Quality Act Guidelines.
2. Award a Construction Contract with Dave Christian Construction Inc. of Fresno, California in the amount of $406,683.55.

RECOMMENDATION
Staff recommends that the City Council adopt a finding of a Categorical Exemption per staff’s determination, pursuant to Section 15301(c) of the California Environmental Quality Act (CEQA) Guidelines, and award a construction contract with Dave Christian Construction Inc. of Fresno, California in the amount of $406,683.55 as the lowest responsive and responsible bidder for the Shields Avenue Overlay project from Sunnyside Avenue to Fowler Avenue and authorize the Public Works Director or designee to sign the standardized contract on behalf of the City.
EXECUTIVE SUMMARY
The Shields Avenue Overlay, project from Sunnyside Avenue to Fowler Avenue will grind and overlay that portion of Shields Avenue. The project will also make minor concrete repairs to bring curb ramps up to current Americans with Disabilities Act (ADA) standards. Awarding this construction project to Dave Christian Construction Inc. will extend the life of this highly used street.
BACKGROUND
Shields Avenue from Sunnyside Avenue to Fowler Avenue is a heavily used arterial street that is suffering from pavement deterioration. The proposed grind and overlay project will extend the service life of the street and bring effected curb ramps up to current Americans with Disabilities Act standards. The project was initiated in FY14 when the City was awarded a Federal grant from the Regional Surface Transportation Program (RSTP). The design started following the execution of a consultant contract with Peters Engineering Group on November 18, 2016. The preliminary engineering design took approximately two years to complete. There was no Right of Way required for this project.
Staff prepared bid documents with a scope that included a 0.20' asphalt grind and 0.20’ overlay, pavement section repair, concrete repair and striping. The Notice Inviting Bids was published in the Business Journal on February 1, 2019, posted on the City’s website and faxed to eight (8) building exchanges. The specifications were distributed to ten (10) prospective bidders. Seven (7) sealed bid proposals were received and opened in a public bid opening on February 26, 2019. Bids ranged from $406,683.55 to $541,145. Dave Christian Construction Inc. which submitted the bid in the amount of $406,683.55 was determined to be the lowest responsive and responsible bidder for the project. The bids will expire 64 days after the bid opening on May 1, 2019.
Staff recommends that the Council award a construction contract with Dave Christian Construction Inc. of Fresno in the amount of $406,683.55 for the Shields Avenue Overlay Project, from Sunnyside Avenue to Fowler Avenue and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.
ENVIRONMENTAL FINDINGS
Staff performed a preliminary environmental assessment of this project and has determined that it falls within the Categorical Exemption set forth in CEQA Guidelines, Section 15301 (c) Class 1 which exempts the repair and maintenance of existing facilities that involves negligible or no expansion of an existing use. This exemption applies because this project involves the resurfacing of an existing roadway and does not involve the expansion of the roadway to accommodate additional traffic. The purpose of the project is to increase the life of the pavement and provide a smooth riding surface for the motorists. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.
LOCAL PREFERENCE
The local preference was not implemented based on conditions of the Federal Regional Surface Transportation Program grant.
FISCAL IMPACT
The Shields Avenue Overlay from Sunnyside Avenue to Fowler Avenue is located in Council District 4. The overall cost of the project is $567,646.51 and is fully funded by Federal grant from the Regional Surface Transportation Program (RSTP). The project will have no impact to the General Fund. All funds necessary for the contract award are included in this fiscal year’s approved City of Fresno budget. Of the overall budget of the project, $406,683.55, will be used for the construction contract award.
