RECOMMENDATION
Staff recommends City Council authorize the Chief of Police to enter into an agreement with the County of Fresno for the reimbursement of seven (7) Police Officers, one (1) Police Sergeant, and one (1) Crime Analyst who will be assigned to the Adult Compliance Team (ACT) and adopt the 21st Amendment to the AAR No. 2019-133 to appropriate $73,000 funding into the FY 2020 budget.
EXECUTIVE SUMMARY
One of the consequences of Assembly Bill 109, the Public Safety Realignment Act of 2011 (AB109), was the shifting of responsibility for supervising convicted criminals released from state prison facilities to county probation departments. To accomplish this, funding was allocated from the State of California to the 58 counties through the Community Corrections Partnership (CCP) Boards established in each county. The Fresno County CCP established an Adult Compliance Team (ACT) to ensure that convicted criminals are closely supervised after release. A Fresno Police Officer has been part of the ACT Team since its inception in October 2011.
The City of Fresno and the County of Fresno now desire to enter into an agreement to continue funding of seven (7) Police Officers, one (1) Police Sergeant and one (1) Crime Analyst plus equipment which costs shall not exceed $1,960,653 for FY 2020.
BACKGROUND
On June 2, 2016, Council approved the First Amendment to Agreement 16-030, which extends the provision of one (1) Police Officer for ACT through June 30, 2017.
In November 2016, the City of Fresno and the County of Fresno amended the original agreement adding two (2) additional Police Officers and one Sergeant in the ACT Team. The City of Fresno and the County of Fresno desired to enter into a proposed Third amendment to the original agreement, which included the addition of four (4) Police Officers and one (1) Crime Analyst assigned to the MAGEC Team.
The City of Fresno and the County of Fresno entered into the Third Amendment, which stated that the total compensation for the four (4) Police Officers and one (1) Crime Analyst, equipment, and indirect costs shall not exceed $969,000.00 for FY 2017-2018.
ENVIRONMENTAL FINDINGS
This is not a “project” for the purposes of CEQA, pursuant to CEQA Guidelines Section 15378.
LOCAL PREFERENCE
Local Preference was not considered because accepting funding from the State does not include a bid or award of a construction or services contract.
FISCAL IMPACT
There is no impact to the General Fund. The Police Department’s FY 2020 budget has $1,887,563 budgeted for part of this agreement and the attached AAR for $73,000 adds appropriations to fully fund this contract. All costs will be reimbursed by the County of Fresno. The total cost of the program will not exceed $1,960,653 in FY 2020.
