RECOMMENDATIONS

 

Staff recommends that Council approve the Second Amendment to Agreement with Integrated Designs by SOMAM, Inc. in the amount of $11,525 for the ADA Upgrades at the City of Fresno Convention Center; approve the Third Amendment to Agreement with Integrated Designs by SOMAM, Inc. in the amount of $12,760 for the ADA Upgrades at the City of Fresno Convention Center and authorize the Public Works Director or designee to sign and execute the standardized second and third amendments to agreement on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The City of Fresno entered into a Consultant Agreement with Integrated Designs by SOMAM, Inc. in October 2017 for the design of general construction documents for certain ADA upgrades at the Fresno Convention Center. These improvements were called out in the ADA Facilities Transition Plan, as adopted by the Council on September 22, 2016. The initial phase of improvements were fully constructed and completed in July 2019. Staff recommends the Council approve an amendment with the design consultant, in order to complete the companion seating project at the Saroyan Theater, consistent with the funding adopted in the FY2020 budget.

 

BACKGROUND

 

On October 19, 2017 the City of Fresno entered into a Consultant Agreement with Integrated Designs by SOMAM, Inc. of Fresno, CA in the amount of $103,115 with a not-to-exceed contingency of $10,000 for the development of construction plans and specifications for the required ADA Upgrades at the City of Fresno Convention Center.  The plans and specifications for the initial scope of work were completed, approved and fully constructed. The $10,000 contingency as originally authorized by the Council was utilized for the First Amendment to Agreement for the relocation of the unisex restroom at the New Exhibit Hall to an existing 'family restroom' that more easily accommodated the required unisex restroom upgrades than the originally designated location, as well as the modification of the lavatory shelving and lighting within the restrooms of Valdez Hall and Saroyan Theater to accommodate the required ADA Upgrades in a more efficient manner. 

 

The Second Amendment to Agreement in the amount of $11,525 will provide funding to compensate the consultant for the following additional services:

* Relocation of the unisex restroom in Valdez Hall to an existing janitors/electrical room to accommodate the required unisex restroom upgrades more easily than the originally location that was directed by the City. 

* Incorporation of these modifications to the plans submitted to the Building Department for review, approval and permitting.

 

The Third Amendment to Agreement in the amount of $12,760 will provide funding to compensate the consultant for the following additional services:

* Modifications to the construction plans to reflect adjustment of the interior path of travel to the Theater Seating at the Saroyan Theater.

* Additional mechanical and electrical modifications necessary as identified in a pre-bid job walk with the Consultant, Contractor, SMG and City staff. 

* Modifications to the construction plans will be submitted to the Building Department for review and approval as well as addressing any required changes per Plan Check Correction List by the Building Department review, in order to provide for companion seating improvements in the Saroyan Theater. 

 

The total Consultant Agreement with Integrated Designs by SOMAM, Inc. after approval of the Second and Third Amendments to Agreement will be as follows:

The amendments have been approved as to form by the City Attorney's Office.

 

ENVIRONMENTAL FINDINGS

 

By definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378 this item does not qualify as a "project", as defined by CEQA.

 

LOCAL PREFERENCE

 

Local preference was not implemented; however the consultant is a local business.

 

FISCAL IMPACT

 

The ADA Upgrades at the City of Fresno Convention Center project utilizes the General Fund as approved by the Council and appropriated in the FY2020 adopted capital budget. There is no fiscal impact associated with the recommended action.
