RECOMMENDATIONS

 

Staff recommends the City Council adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301 Class 1 of the CEQA Guidelines for the Cedar Avenue Overlay project; award a construction contract with Cal Valley Construction, Inc. in the amount of $563,240 as the lowest responsive and responsible bidder, and authorize the Public Works Director or Designee to sign a standardized contract on behalf of the City.

 

EXECUTIVE SUMMARY

 

Cedar Avenue, between Barstow and Bullard Avenues, is in a need of repair to address surface and structural damage caused by age, weather and use. This proposed asphalt grind and overlay project will correct the existing deteriorated pavement condition, increase the useful life of the pavement, and provide a smooth riding surface for motorists. Several curb ramps within the project limits will be upgraded to conform to current accessibility standards.  This pavement overlay project is funded through SB1 revenues in accordance with the adopted FY2019 budget.

 

BACKGROUND

 

The design phase of this project was initiated in FY2019 when the City Council approved a list of projects to receive Senate Bill 1 (SB1) Road Maintenance and Rehabilitation Account funding and the project was budgeted in the Council-adopted FY2019 Capital Budget.  Department of Public Works staff designed the project, which took approximately 12 months to complete.

 

The scope of work for the Cedar Pavement Overlay includes a grind and overlay of Cedar Avenue, between Barstow and Bullard Avenues, as well as curb ramp reconstruction that complies with Americans with Disabilities Act (ADA) requirements and replacement of existing vehicle detection loops.  Pavement striping will replace the existing travel lane configuration, including Class II bike lanes in both directions.

 

Staff prepared a Notice Inviting Bids, which was published in the Fresno Business Journal on November 15, 2019, posted on the City’s website, and faxed to nine building exchanges.  Project plans and specifications were distributed to 32 prospective bidders.  Eight sealed bid proposals were received and opened in a public bid opening on December 10, 2019, with bids ranging from $537,241.56 to $626,005.  After application of the 5% Local Preference adjustment, Cal Valley Construction, Inc., of Fresno, with their bid of $563,240, was determined to be the lowest, adjusted responsive and responsible bidder.  The expiration date of the bids is February 12, 2020.  If the bids are rejected or expire the project must be rebid, which will result in a delay of approximately 60 days.

 

The City Attorney’s Office has reviewed and approved as to form.

 

Staff is recommending award of a construction contract to Cal Valley Construction Inc., in the amount of $563,240 to construct the Cedar Avenue pavement overlay from Barstow Avenue to Bullard Avenue, as the lowest responsive and responsible bidder, and to authorize the Public Works Director or designee to sign and execute the contract on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

Staff performed a preliminary environmental assessment of this project and determined that it falls within the Categorical Exemption set forth in CEQA Guidelines, Section 15301(c) Class 1 which exempts the repair and maintenance of existing facilities that involves negligible or no expansion of an existing use.  This exemption applies because this project involves the reconstruction of an existing roadway and does not involve the expansion of the roadway to accommodate additional traffic.  The purpose of the project is to replace the surface pavement and provide a smooth riding surface for the motorists.  Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.

 

LOCAL PREFERENCE

 

The project funding is through SB1 and considered locally funded.  The City’s local preference adjustment was implemented as the apparent low bid was from a contractor located outside the City of Fresno.  The bid received from Cal Valley Construction, Inc., of Fresno, CA was determined to be the adjusted lowest responsive and responsible bid.

 

FISCAL IMPACT

 

This project is located in City of Fresno Council District 4.  The overall cost of the project is $699,800.00 and is locally funded by SB1 Gas Tax.  The project will not have any impact to the General Fund.  Of the total project cost, $563,240 will be used for the construction contract award.  All funds necessary for the contract award are included in the current fiscal year budget as previously adopted by the Council.
