1. Adopt a finding of Categorical Exemption per staff determination, pursuant to Section 15301/Class 1, 15302/Class 2, and 15303/Class 3 of the California Environmental Quality Act (CEQA) Guidelines

RECOMMENDATIONS
Staff recommends the City Council adopt a finding of Categorical Exemption per staff determination, pursuant to Section 15301/Class 1, 15302/Class 2, and 15303/Class 3 of the CEQA Guidelines for the Herndon Avenue and Shaw Avenue Corridors Pedestrian Signalization Upgrades, award a construction contract with Cen-Pac Engineering in the amount of $137,772.00 as the lowest responsive and responsible bidder, and authorize the Public Works Director or Designee to sign a standardized contract on behalf of the City of Fresno.
EXECUTIVE SUMMARY
This Highway Safety Improvement Program (HSIP) grant project was awarded to the City of Fresno in 2018 with the Preliminary Engineering phase approved in the spring of 2019. The Herndon Avenue and Shaw Avenue Corridors Pedestrian Signalization Upgrade Project will remove and replace existing pedestrian signal heads at every traffic signal along Shaw Avenue, from West Avenue to Chestnut Avenue, and Herndon Avenue from Golden State Boulevard to Willow Avenue. The proposed work includes the removal of existing pedestrian heads at each intersection, which will then be replaced with countdown heads.
BACKGROUND
The Herndon Avenue and Shaw Avenue Corridors Pedestrian Signalization Upgrade Project will remove and replace existing pedestrian signal heads at every traffic signal along Shaw Avenue, from West Avenue to Chestnut Avenue, and Herndon Avenue, from Golden State Boulevard to Willow Avenue totaling thirty-two (32) intersections. The proposed work includes the removal of existing pedestrian heads at each intersection which will then be replaced with countdown heads to provide pedestrians clear notice of when to proceed with crossing the intersections, as well as providing the green-time remaining in the pedestrian phase of the traffic signal operation. The engineering and design took approximately 6 months to complete.
This project was previously bid in 2019 as two separate projects, however, all bidders on both projects failed to provide required bid information and their bids were rejected due to non-responsiveness. Public Works staff combined the two projects, modified the bid documents to provide additional clarity, and rebid with the intent to secure a viable contractor for the two corridor projects.
A Notice Inviting Bids was published in the Business Journal and posted on the City’s website on November 20, 2019 and sent to eight (8) building exchanges. Specifications were distributed to thirty-six (36) prospective bidders. Five (5) sealed bids were received and opened in the public bid opening held at City Hall on December 17, 2019 with bid proposals ranging from $137,772.00 to $297,224.00. Cen-Pac Engineering, with their bid of $137,772.00, was determined to be the lowest responsive and responsible bidder. The expiration date of the bids is February 19, 2020. If the bids are rejected or expire, the project must be rebid, which will result in a delay of approximately 60 days.
The City Attorney’s Office has reviewed and approved as to form.
Staff is recommending award of a construction contract to Cen-Pac Engineering in the amount of $137,772.00 for the Herndon Avenue and Shaw Avenue Corridor Pedestrian Signalization Upgrades as the lowest responsive and responsible bidder and to authorize the Public Works Director or designee to sign and execute the contract on behalf of the City of Fresno.
ENVIRONMENTAL FINDINGS
Staff has performed an environmental assessment of this project and has determined that it falls within the Categorical Exemption set forth in CEQA Guidelines Section 15301/Class 1, 15302/Class 2, and Section 15303/Class 3. Section 15301/Class 1 exempts the repair, maintenance, or minor alteration of existing structures or facilities, which includes existing streets, sidewalk and gutters, and no further expansion of existing use. Section 15302/Class 2 which exempts the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced. Section 15303/Class 3 exempts the construction and location of limited numbers of new, small facilities or structures, and installation of small, new equipment and facilities in small structures, which includes street improvements of reasonable length to serve the construction. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2, apply to this project.
LOCAL PREFERENCE
Local preference was not implemented based on conditions of federal funding.
FISCAL IMPACT
The projects are located in City of Fresno Council Districts 1, 2, 4, and 6. The overall cost of the projects is $222,380.00 and are 100% federally funded by HSIP. The projects will not have any impact to the General Fund. Of the total project cost, $137,772.00 will be used for the construction contract award. All funds necessary for the contract award are included in the current fiscal year budget as previously adopted by the Council.
