RECOMMENDATIONS
Staff recommends that City Council approve the First Amendment to the Professional Consultant Services Agreement with Stantec Consulting Services, Inc., to complete expanded scope of services and extended duration of the construction phase for the Odor Control Replacement Project.
EXECUTIVE SUMMARY
Through a competitive consultant selection process Stantec Consulting Services was awarded a contract to provide engineering design, bidding support, and engineering support during construction for a replacement Headworks building odor control system that had reached the end of its useful life. This amendment is for additional design services and engineering support during construction that has been necessitated by construction contractor challenges. Completion of the odor control improvements will ensure compliance with San Joaquin Valley Air Pollution Control District regulations and reduce maintenance costs.
BACKGROUND
On March 28, 2014, Council awarded a consultant services agreement to Stantec Consulting Services for the Design of a New Odor Control System for the Headworks building at the Fresno-Clovis Regional Wastewater Reclamation Facility (RWRF). The agreement is a standard five-part contract consisting of Schematic Design, Design Development, Construction Documents, Bidding Support, and Construction Phase and General Construction Contract Administration. During the Construction Document Phase, RWRF staff requested several improvements to the design that expanded the scope of services and utilized available contingency funds. These revisions led to additional consultant time for design, submittal review, and support during construction. During the construction phase, the consultant was directed to take over the design of pipe support systems needed for the 48-inch and 80-inch fiberglass ducts for the odor control system. Lastly, due to ongoing construction contractor challenges, the construction phase of the project has extended well beyond the estimated duration. The consultant has continued to provide support during this extended period. At this time, the design consultant has almost exhausted the original fee and contingency funds. This amendment expands the scope of services and fee thus ensuring continued engineering support through project completion. Staff has negotiated an increase in compensation for services in the amount of $31,718, and extends the existing Agreement through June 2020, to complete these services.
Upon approval by the City Council, the First Amendment to Agreement will be executed by the Director of Public Utilities, or his designee.
This First Amendment has been approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(5), this is not a “project” for the purpose of CEQA, as this is an organizational or administrative action of the government to enforce an existing obligation, and will not result in a direct or indirect physical change in the environment.
LOCAL PREFERENCE
Local preference was not implemented because this is an amendment to an existing consultant services agreement.
FISCAL IMPACT
This amendment has no financial impact on the General Fund. This project is located in Council District 3 and provides citywide benefit. Funds for the completion of this construction project are budgeted in Fiscal Year 2020 and available in the Sewer Enterprise Fund 40501.
