RECOMMENDATION

 

Staff recommends Council approve a Fourth Amendment to the professional consultant agreement with Blair, Church & Flynn, Consulting Engineers, Inc., (BC&F) in the amount of $32,462, to provide additional civil engineering design services and prepare construction documents necessary to complete the design and construction of Phase One of the Peach Avenue Widening Project between Butler and Florence Avenues and authorize the Public Works Director or designee to sign the fourth amendment to agreement on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The City of Fresno seeks to construct street improvements and widen Peach Avenue between Butler and Jensen Avenues from two lanes to a four-lane arterial with median landscaping, left turn lanes, bike lanes, curb and gutter, sidewalk, landscaping, streetlights, and traffic signal facilities.  Due to funding availability the project will be constructed in two phases; from Butler Avenue to Florence Avenue (Phase One) and Florence Avenue to Jensen Avenue (Phase Two).  The consultant completed the 90 percent plans and specifications for Phase One and Phase Two.  Prior to completion of the 100 percent plans, the project experienced delays due to environmental clearance and railroad crossing issues.  The City desires to amend the scope of the Agreement to allow for the completion of 100 percent plans, including bidding and construction support services, for Phase One.  Staff recommends approval of this Fourth Amendment to agreement with BC&F in the amount of $32,462 to provide additional civil engineering design services and preparation of construction documents for Phase One of the Peach Avenue Widening Project between Butler and Florence Avenues.

 

BACKGROUND

 

The City entered into a consultant agreement with BC&F on February 21, 2013, to provide civil engineering design services and preparation of construction documents for Peach Avenue Widening between Jensen and Butler Avenues.  The Project is funded by Measure “C” and local developer impact fees.  On December 11, 2013, the Agreement was amended in the amount of $13,400 (First Amendment) to provide additional design services for the addition of a new traffic signal at Peach and Hamilton Avenues. 

 

The Agreement was amended again on July 13, 2014, in the amount of $26,300 (Second Amendment) to split the project into two phases and provide two separate construction plans, specifications, and estimates.  The project was split into two phase due to construction funding availability. The two phases include widening Peach Avenue from Butler Avenue to Florence Avenue (Phase One) and Florence Avenue to Jensen Avenue (Phase Two). 

 

The Agreement was further amended on September 19, 2018, (Third Amendment) to revise and update the September 2014 CEQA Initial Study.  The scope and fees for Parts 4 and 5 of the agreement were removed to reallocate funds for the Third Amendment.  The Third Amendment was a total net change of $0 to the Agreement.

 

The City now desires to amend the consultant agreement with BC&F in the amount of $32,462, to complete the final construction documents and provide bidding and construction support services for Phase One of the Project.  This amendment includes updating the consultants billing rates due to delays in the project, addresses design revisions and replenishes funding that was reallocated with the Third Amendment for Part 4 (Bidding Support) and Part 5 (Construction Support) for Phase One of the Project.

 

City Attorney has reviewed and approved as to form the amendment to the consultant agreement.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, the award of these contracts does not qualify as a project for the purposes of CEQA.

 

LOCAL PREFERENCE

 

Local preference was not implemented because this is an amendment to an existing agreement.

 

FISCAL IMPACT

 

This project will have no impact to the General Fund.  The Project is fully funded by Measure “C” and local developer impact fee dollars.  The appropriations for this amendment are included in the current fiscal year budget as adopted by City Council.
