1. Approve Consent to Assignment, for a Business Alliance between Northstar General Inc., and Quiring General, LLC., allowing Quiring to Act as General Contractor and provide bonds for the project

RECOMMENDATIONS
Staff recommends that City Council approve the consent to assignment for a business alliance between Northstar General Inc., and Quiring General, LLC., allowing Quiring to act as the general contractor and provide the bonds for the project, and approve the side agreement with Quiring General, LLC.
EXECUTIVE SUMMARY
Council approved the construction contract on May 21, 2020, with Northstar General Inc., but due to extenuating circumstances, Northstar General Inc. has been unable to obtain the required Bonds for the project. Northstar General Inc. and Quiring General, LLC., shall enter into a Business Alliance Agreement where Quiring General, LLC., will provide the Bonds provided they are assigned to the Project as its licensed general contractor. The City shall enter a Side Agreement with Quiring General, LLC to list them on the project as the licensed general contractor.
BACKGROUND
The new Animal Control Facility will be located on the 5.1-acre property acquired from The Gap, Inc., in February 2020, with an address of 5277 E. Airways Blvd, Fresno, CA 93727. The facility will contain five buildings, ranging in sizes from approximately 3,800 to 13,250 sq. ft. The five buildings in the complex will consist of a main building for the administrative, operational, and customer service uses; a second building that will house the veterinarian services and isolation rooms for injured and recovering animals; and the remaining three buildings will provide animal housing.
ENVIRONMENTAL FINDINGS
On February 13, 2020, Council adopted the findings of Statutory Exemption pursuant to CEQA Guidelines Section 15183 for the proposed project. It is considered to be exempt from environmental review pursuant to CEQA Guidelines Section 15183, projects consistent with a community plan, general plan, or zoning. The proposed project is consistent with the land use designation and development intensities assigned to the project by the City of Fresno General Plan. Cumulative impacts associated with development as buildout of the project site, as proposed project is consistent in the City of Fresno Master EIR (SCH#2012111015) (MEIR). Since the proposed project is consistent with the land use designation and development intensity for the site identified in the General Plan and analyzed in the MEIR, beyond those addressed in the MEIR.
LOCAL PREFERENCE
Local preference was not implemented but, Northstar General, Inc., and Quiring General, LLC., are both local businesses.
FISCAL IMPACT
All project costs will be paid for by appropriations from the Animal Control Facility fund. The reimbursement resolution will allow for these expenditures to be financed through bond proceeds. Ongoing operational expenses for the facility will be included in City budgets for FY2022 and beyond, in a similar manner as the historical budgetary approach with the CCSPCA contractual expenses.
