Adopt Resolution of Intention to amend Annexation Map No. 14, Final Tract Map No. 5232, of the City of Fresno Community Facilities District No. 11 (CFD No. 11).
EXECUTIVE SUMMARY
The landowners of territory within the boundaries of Annexation Map No. 14, Final Tract Map No. 5232, of CFD No. 11 have sold the territory known as Outlot K to another developer to be subdivided. That subdivision, Final Tract Map No. 6291, is required to remove that territory from Annexation Map No. 14 of CFD No. 11 as part of the map conditions. The developer of Final Tract Map No. 6291 has petitioned the City separately to annex to CFD No. 11. This requires modification to the previously recorded amended Annexation Map No. 14 and requires Council approval per City Law. As the officer having charge and control of the Services of CFD No. 11, the Public Works Director is requesting to the removal of the territory known as Outlot K of Final Tract Map No. 5232 from Annexation No. 14 of CFD No. 11 by amending Annexation Map No. 14. This Amended Annexation Map No. 14 will supersede all previously recorded maps and is required to record within ten days after Council approval. No further action is required upon recordation. BACKGROUND
On January 14, 2016, the Council of the City of Fresno (Council) adopted Council Resolution No. 2016-04 to amend the boundaries of Annexation No. 14, Final Tract Map No. 5232, of the City of Fresno Community Facilities District No. 11 (CFD No. 11) per the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (City Law) and the Streets and Highways Code, commencing with Section 3110, of the California Government Code.
The amended boundaries for Annexation Map No. 14 of CFD No. 11 were recorded on January 29, 2016, at Book 44, Page 53, of Assessment and Community Facilities Districts in the Office of the Recorder, County of Fresno, California.
The landowners have sold the territory known as Outlot K, within the boundaries of Final Tract Map No. 5232, Annexation Map No. 14 of CFD No. 11, to another developer to be subdivided. That subdivision, Final Tract Map No. 6291, is required to remove that territory from Annexation Map No. 14 of CFD No. 11 as part of the map conditions. The developer of Final Tract Map No. 6291 has petitioned the City separately to annex that map to CFD No. 11. The modification to remove territory and amend Annexation Map No. 14 requires Council approval per City Law.
Amending Annexation Map No. 14 to remove Outlot K from the boundaries of Annexation No. 14 will not change the Rate and Method of Apportionment (RMA) adopted for Annexation No. 14. When Final Map No. 5232 was recorded and annexed into CFD No. 11, Outlot K was territory set aside for development as a future neighborhood. The Services funded by Annexation No. 14 do not include any maintenance or other work associated with the previously anticipated neighborhood park. Thus, this action does not require any modifications to the RMA for Annexation No. 14.

The attached Resolution has been approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
Pursuant to the definition in California Environmental Quality Act (CEQA) Guidelines Section 15378, this action is not a project.
LOCAL PREFERENCE
Local preference was not implemented, as this item does not include a bid or award of a construction or services contract.
FISCAL IMPACT
No City funds will be involved. All costs for services will be borne by the property owners within the subject tract.
