Actions pertaining to the Tulare Avenue Complete Streets Project between 6th Street to Cedar Avenue (Council Districts 5 and 7):
1. ***RESOLUTION - 43rd Amendment to the Annual Appropriation Resolution No. 2020-159 appropriating $40,500 for the Tulare Avenue Complete Streets Project Between 6th Street and Cedar Avenue (Requires 5 affirmative votes) (Subject to Mayor’s veto)
2. Approve an agreement for Professional Engineering Services with Peters Engineering Group for $193,360, with a $10,000 contingency, for design and construction support services

RECOMMENDATIONS
Staff recommends the City Council (1) adopt the 43rd Amendment to the Annual Appropriation Resolution (AAR) No. 2020-159, (2) Approval of an agreement for Professional Engineering Services with Peters Engineering Group, for $193,360 with a $10,000 contingency for the design and construction support phases of the Tulare Avenue Complete Streets Project between 6th Street and Cedar Avenue and to allow the Public Works Director or designee to sign the agreement on the City’s behalf.
EXECUTIVE SUMMARY
The Tulare Avenue Complete Streets Project between 6th Street and Cedar Avenue will increase the pedestrian and bicycle infrastructure available to students and their families in the Jackson and Rowell Elementary School neighborhoods. This project will install and widen sidewalks along the south side of Tulare Avenue, upgrade curb ramps, restripe the roadways to include a road diet and class II bike lanes and install additional street lights. The project is funded by a Federal Congestion Mitigation and Air Quality (CMAQ) Improvement Program grant. The subject consultant agreement in the amount of $193,360, with a $10,000 contingency, will facilitate the design and construction support services necessary to complete the project. This agenda item also includes a budget action to appropriate the necessary Tulare Complete Streets Project funding into the capital budget for the Public Works Department.
BACKGROUND
This project has been requested by community members working collaboratively with families at Jackson and Rowell Elementary Schools. Many students walk to school and have requested improved infrastructure to support active transportation through the area. In October of 2017, the City of Fresno applied for a Federal CMAQ grant for the design and construction phases of this bike and pedestrian project to install and widen sidewalks along the south side of Tulare Avenue, upgrade curb ramps to meet ADA compliance, restripe the roadways to include a road diet and class II bike lanes and install additional street lights, all which will improve connectivity through this area. The purpose of this project is to increase the pedestrian and bicycle infrastructure available to students and their families in the Jackson and Rowell Elementary School neighborhoods.
In accordance with Administrative Order (A.O.) 6-19, staff sent out requests for Statements of Qualifications (SOQ’s) in March of 2020 via Planet Bids, email and published in the Business Journal. Four SOQ’s were received and staff interviewed the top three qualified respondents. Peters Engineering Group was determined as the most qualified consultant and staff negotiated a fee of $193,360, with a $10,000 contingency, for the preparation of plans, specifications, cost estimates, bidding support services and construction support services for the project.
Staff is recommending the approval of the attached AAR amendment and the agreement with Peters Engineering Group for $193,360, with a $10,000 contingency, for the design of plans, cost estimates and general construction documents for the Tulare Avenue Complete Streets Project from 6th Street to Cedar Avenue, and authorize the Public Works Director or designee to sign and execute the contract, approved as to form by the City Attorney’s Office, on behalf of the City of Fresno.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act (CEQA) guidelines, this item is not a project as defined by CEQA.
LOCAL PREFERENCE
Local preference was not implemented for this project due it being a Federal Highway Administration funded grant through the CMAQ Program.
FISCAL IMPACT
This project is located in City of Fresno Council Districts 5 and 7. The design and construction of the project will not impact the General Fund. This project is funded with a Federal CMAQ grant, administered by Caltrans on behalf of the Federal Highway Administration. Adoption of the attached AAR amendment resolution will appropriate the necessary funding to award the consultant agreement for the Tulare Avenue Complete Streets Project.
