RECOMMENDATIONS

 

Staff recommends the City Council conduct the required public hearing and at the close of the hearing, adopt the attached resolution ordering the vacation of a portion of East Illinois Avenue between North Valeria Street and North Fresno Street.

 

EXECUTIVE SUMMARY

 

Community Regional Medical Center is requesting the vacation of a portion of East Illinois Avenue between North Valeria Street and North Fresno Street as shown on Exhibit “A” of the attached Resolution of Intent.  The purpose of this vacation is to accommodate development associated with conditional use permit number C-16-011.

 

BACKGROUND

 

This portion of East Illinois Avenue was originally dedicated as public street right of way by the map of Hadsell’s Addition recorded in Volume 1 of Plats, at Page 14, Fresno County Records.  This proposed vacation will accommodate development associated with conditional use permit number C-16-011.  This conditional use permit will allow for private access and the placement of private utilities for the ongoing development of the Community Regional Medical Center campus.  The surrounding streets and ally have been previously vacated by resolution number 95-77 and resolution number 2007-245.  This proposed vacation would be consistent with the previous vacations and allow for future development of this facility.

 

The Public Works Department, other City departments and utility agencies have reviewed the proposed vacation and determined that the public street right of way easement proposed for vacation is unnecessary for present or prospective public street right of way, as shown on Exhibit “A”, subject to conditions of approval as listed in Exhibit “B”, said Exhibits are included in the attached Resolution.

 

The City Attorney’s Office has approved the attached Resolution to Vacate as to form.

 

The vacation, if approved by the Council at the public hearing, will become effective when the vacating resolution is recorded in the office of the Fresno County Recorder, but not until the City Engineer determines that the conditions listed in the attached resolution have been satisfied and accepted by the City.

 

ENVIRONMENTAL FINDINGS

 

Master Environmental Impact Report (MEIR) Number 10120 relating to and environmentally assessing the proposed development formally known as the Central California Regional Medical Center, now known as Community Regional Medical Center has been prepared in compliance with the California Environmental act (CEQA). On February 14 and 21, 1995 the City Council for the City of Fresno held a public hearing to consider final MEIR Number 101020, and all written and oral evidence and testimony related thereto.  On February 21, 2020 the City Council, by Resolution Number 95-55, certified the Final MEIR Number 10120 for the Community Regional Medical Center, and found that the project, including the subject vacation, is consistent with the General Plan and determined that this project does not have any additional significant impact on the environment that was not identified in the MEIR.  The Council also determined that no new or additional mitigation measures or alternatives will be required.

 

LOCAL PREFERENCE

 

Local preference does not apply because the vacation of a public street easement does not involve bidding or contracting.

 

FISCAL IMPACT

 

This project has no impact to the General Fund and is located in Council District 7. Community Regional Medical Center has paid all processing fees to cover staff cost in accordance with the Master Fee Schedule.
