RECOMMENDATION

 

Staff recommends that Council adopt a finding of Categorical Exemption pursuant to section 15306 of CEQA; approve the Third Amendment to the Consultant Services Agreement with Kleinfelder Inc. in an amount not to exceed $126,000 for professional geotechnical engineering/environmental services; and that council establish a contingency fund of $200,000 for future additional mandates.

 

 

EXECUTIVE SUMMARY

 

Prompted by improvements at the adjacent property, the Parks, After School, Recreation and Community Services Department (PARCS) received notification by the Central Valley Regional Water Quality Control Board (CRWQCB) to implement testing of the groundwater and soil at the Maxie L Parks site. Initial work began early 2020 with subsequent testing concluding in May 2020.  Additional recommendations from findings have been identified by CRWQCB. Council approval is requested to approve additional services of Kleinfelder and appropriate additional funds to cover associated costs with implementing the additional scope of work.   

 

BACKGROUND

 

On May 1, 2019, the Central Valley Regional Water Quality Control Board (CRWQCB) requested a work plan from the City to investigate the groundwater and soil at the Maxie L Parks site, due to elevated contaminant findings at another nearby site.  PARCS acquired the services of Krazan and Associates to prepare the workplan per the specifications requested by the CRWQCB.    Since the cost to implement the workplan was expected to be less than $50,000, three informal bids were solicited from local qualified firms.  On January 6, 2020, PARCS entered into a Consultant Agreement with Kleinfelder Inc. to implement the workplan for a total fee of $40,500.  The agreement was later amended to include a time extension granted by CRWQCB to allow additional time for permitting and analysis. Findings during the preliminary investigation led Kleinfelder to contact PARCS and recommend additional tests be performed to provide a more comprehensive analysis. In compliance with the required reporting to CRWQCB, Kleinfelder developed an additional work plan and change order outlining the proposed scope of work, and estimated the cost for the additional services would not exceed $35,000.  By way of the Second Amendment, Council approved a contingency fund not to exceed an additional $20,000 to address any additional requirement directed by CRWQCB. Therefore, the total preauthorized amount approved in April 2020 was not to exceed $55,000.

 

The results of those findings were reviewed by CRWQCB and further recommendations were made to create a work plan to address findings and the item before Council today is to approve the implementation of the proposed work plan (see attachments) at a fee not to exceed $126,000. A contingency of up to $200,000 has also been included in the Amendment and is part of this request for approval by Council.

 

ENVIRONMENTAL FINDINGS

 

This project is exempt pursuant to section 15306 of the CEQA Guidelines, which exempts basic data collection, research, experimental management, and resource evaluation activities which do not result in a serious or major disturbance to an environmental resource, because the work being performed is soil testing for potential contamination issues that will not result in major disturbance to an environmental resource.

 

LOCAL PREFERENCE

 

Local preference was not considered because the initial award was under the formal bid limit for a Consultant Agreement.  PARCS did contact local firms during the informal bid process. Kleinfelder Inc. has an office located in Fresno.

 

FISCAL IMPACT

 

General Fund dollars have been identified to cover this investigation requested by the Central Water Regional Water Quality Control Board.
