Staff recommends that City Council approve Contract Change Order No. 04 with Emmett’s Excavation Inc., for a total increase in contract amount of $179,372 for the Inyo Street Overlay Project. 

 

EXECUTIVE SUMMARY

 

Staff recommends that Council approve Contract Change Order No. 04 for the Inyo Street Overlay Project.  This Change Order allows for the change in scope of work to ensure the existing underlaying old concrete road surfaces, previously unknown, are removed and replaced with new structural sections to ensure proper structural support and a long-term life span of the new surfacing. 

 

City Council approval of Contract Change Order No. 04 will allow for payment to Emmett’s Excavation, Inc., to demolish and rebuild Inyo Street to current engineering specifications. The project is funded through a Federal grant from the Regional Surface Transportation Program (RSTP).

 

BACKGROUND

 

On May 14, 2020, a Contract was awarded in the amount of $583,240 to Emmett’s Excavation, Inc., for the Inyo Street overlay project between Van Ness and P Streets.  The Notice to Proceed was issued with a starting date of September 28, 2020, and completion date of December 2, 2020.  There have been three Contract Change Orders executed to date for a total amount of $49,441 and a net change of 8.5% from the original contract price.

 

During the course of work previously unknown sections of thick concrete pavement were encountered. The old concrete roadway section, being just below the existing asphalt surface, prevented the contractor from utilizing grinding equipment to remove the asphalt and overlay with new asphalt. Current technology and equipment do not allow for grinding of concrete without damage to equipment. 

 

Contract Change Order No. 04 will provide payment to Emmett’s Excavation, Inc., to remove and haul off the existing below-grade concrete street section, then process and prepare the existing subgrade prior to import of new engineered material. This was an unforeseen condition and was not included in the original contract scope of work.

 

Staff recommends that City Council approve Contract Change Order No. 04 on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

By the definition set forth within California Environmental Quality Act (CEQA) Guidelines, Section 15378, the approval of these Contract Change Orders does not qualify as a project for the purpose of CEQA. 

 

LOCAL PREFERENCE

 

Local Preference was not implemented because this action is a change order to an existing construction contract.

 

FISCAL IMPACT

 

This Contract Change Order has no impact to the General Fund and will be 100% Federally Funded through the Regional Surface Transportation Program (RSTP).
