SUBJECT

Title

RESOLUTION - amending certain designated positions which shall be subject to the Conflict of Interest Code and defining categories of disclosures for such positions

Body

RECOMMENDATION

To continue to comply with the Political Reform Act of 1974 (the Act) staff recommends that the attached resolution revising some of the Exhibits to the City of Fresno's Conflict of Interest Code be adopted.

EXECUTIVE SUMMARY

The Act requires all governing agencies to review and update their Conflict of Interest Codes, annually if necessary. As April 1, 2022, is the filing deadline for 2021, the Council and Agency Board customarily conducts this review in November of each year so that required filers are identified prior to the annual filing period of January 1, 2021 through April 1, 2021.

BACKGROUND

In accordance with the Act, the City Council and the Redevelopment Agency Board ("Board") is the code reviewing body for the City of Fresno's Conflict of Interest Code. Part of the City of Fresno's Conflict of Interest Code consists of the Exhibits, which list the employee classifications required to file statements of economic interests, together with the types of economic interest those employees filing the classifications must disclose.

The current Conflict of Interest Code was before Council for approval on November 19, 2020 and was approved as Council Resolution 2020-293 and Successor Agency to the Redevelopment Agency Resolution number SA-45 Since then, several changes have been identified and submitted to the City Clerk's Office. The requested changes are outlined in the exhibits in "red".
