Staff recommends Council (1) adopt a finding of Categorical Exemption per staff determination, pursuant to Section 15301/Class 1 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PC00362, for Roeding Tot Lot and ADA Accessibility Improvement Project; (2) adopt a finding of Categorical Exemption per staff determination, pursuant to Section 15301/Class 1 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PC00363, for Woodward Tot Lot and ADA Accessibility Improvement Project; and (3) award a construction contract to American Paving Company of Fresno, California, in the amount of $1,962,257 as the lowest responsive and responsible bidder and authorize the Capital Projects Director or designee to sign the construction contract on behalf of the City.

 

EXECUTIVE SUMMARY

 

The City of Fresno Parks, After School, Recreation, and Community Services (PARCS) Department seeks to rehabilitate and replace existing play structures and improve accessibility at different locations within the City’s Regional Parks (Woodward and Roeding). Staff recommends Council approve the award of a construction contract in the amount of $1,962,257 to American Paving Company of Fresno, California. The project is funded through General Funds, Regional Parking Revenue, and Measure P, Expenditure Category 1.

 

BACKGROUND

 

Woodward Park is located on the southwest corner of Friant Avenue and Fort Washington Road and Roeding Park is located on the southwest corner of Golden State Boulevard and Olive Avenue. In an effort to improve the condition and accessibility of the play structures located within the City’s Regional Parks (Woodward and Roeding), an assessment of the existing play structures and accessibility to them was initiated through a consultant agreement with Quad Knopf Inc., dba QK (QK), on April 14, 2022. After examining the prevailing site conditions at both locations, QK provided a comprehensive planning and development strategy with the intention of rehabilitating the existing play structures at Woodward Park, replacing the play structures at Roeding Park, and removing any accessibility barriers at each park playground site. As a result of the recommendations, PARCS moved forward with implementing the proposed enhancements at four (4) different play area locations within Woodward Park: Park View, Valley View, River View, and Art of Life; and two (2) different play locations within Roeding Park: Maple Grove and Pine Grove. Incorporated within the project design is a comprehensive scope to reconstruct the existing paths of travel, refurbish parking stalls, and provide site amenities that adhere to the Americans with Disabilities Act (ADA) accessibility standards.

 

In July 2023, the Woodward Tot Lot and ADA Accessibility Improvements Project was previously advertised as a standalone project and one bid was received. The received bid was twenty-eight percent (28%) above the engineer’s estimate and exceeded the funding allocation for the project. Upon rejection of the bid by City Council in October 2023, staff worked with the consultant to revise and repackage the project together with the Roeding Tot Lot and ADA Accessibility Improvements Project.

 

The Notice Inviting Bids for the Woodward and Roeding Tot Lots and ADA Accessibility Improvements Project was advertised and published in the Business Journal and Planet Bids on January 10, 2024, and posted on the City’s website. Seven (7) building exchanges received the Notice Inviting Bids.  The specifications were distributed to fifty (50) prospective bidders. Two (2) sealed bid proposals were received and opened in a public bid opening on February 20, 2024, with bids ranging from $1,962,257 to $2,191,763.  American Paving Co. of Fresno, California submitted the bid in the amount of $1,962,257 and was determined to be the lowest responsive and responsible bidder for the project. This project is funded through General Funds, Regional Parking Revenue, and Measure P, Expenditure Category 1, appropriated in FY 2024. The bids will expire on April 24, 2024.

 

Staff recommends Council award a construction contract to American Paving Co. of Fresno, California, in the amount of $1,962,257, to construct the Woodward and Roeding Tot Lots and ADA Accessibility Improvements Project, as the lowest responsive and responsible bidder, and authorize the Capital Projects Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.

 

This contract is covered by the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement To Be Bound.

 

The City Attorney’s Office has reviewed and approved this item as to form.

 

ENVIRONMENTAL FINDINGS

 

Staff performed a preliminary environmental assessment of this project and determined that it falls within the Categorical Exemption set forth in CEQA guidelines, Section(s) 15301/Class 1 for both Woodward and Roeding Parks because the project includes minor alterations to an existing facility. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, section 15300.2 apply to this project.

 

LOCAL PREFERENCE

 

American Paving Co. is a local business, as defined by the Fresno Municipal Code.

 

FISCAL IMPACT

 

The Woodward and Roeding Tot Lots and ADA Accessibility Improvements Project is in Council District 3 and Council District 6. The project is funded through General Funds, Regional Parking Revenue, and Measure P, Expenditure Category 1, appropriated in FY 2024. Additional funds will be appropriated in FY 2025 through Parks Special Parking Revenue Funds for construction phase soft costs and project closeout.
