RECOMMENDATIONS
Staff recommends that Council approve Amendment to the Agreement with Partners in Control, Inc. to include the addition of cyber and professional liability insurance requirements for update of the City of Fresno’s Northeast Surface Water Treatment Facility Vijeo CitectSCADA and Modicon Unity Pro PLC Software system, and authorize the Director of Public Utilities, or designee, to execute the Amendment on behalf of the City of Fresno.
EXECUTIVE SUMMARY
This Amendment to the Agreement with Partners in Control, Inc. (Contractor), amends the original Agreement to include the addition of cyber and professional liability insurance requirements for necessary updates to the City of Fresno’s (City’s) Vijeo CitectSCADA and Modicon Unity Pro PLC Software system for the City’s Northeast Surface Water Treatment Facility (NESWTF). Council approval of this Amendment will memorialize these requirements without increase to the original Agreement budget.
BACKGROUND
On June 25, 2015, and upon Council approval, the City entered into an agreement for installation and integration of an updated SCADA system software program for the City’s NESWTF. The original Agreement was approved for a total fee of $1,204,814, and included standard vendor insurance requirements. Thereafter, the City and the Contractor agreed to update the insurance requirements by providing additional necessary and beneficial coverages specific to cyber system installations. The City and the Contractor now request Council approval of this Amendment.
This Amendment has been approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
Adoption of this Amendment is not a “project” pursuant to CEQA Guidelines Section 15378.
LOCAL PREFERENCE
Local preference was not implemented because this is not a competitive bid award.
FISCAL IMPACT
There is no impact to the General Fund. This Amendment will not increase the cost of the Agreement and the funds for this project were included in the Water Division’s FY2015 Capital Improvement Program budget within the Water Enterprise Fund (40101). Funding for the project was included in the water rate model used to create the five-year utility rate plan and subsequently adopted by City Council on February 26, 2015.
