Title
Actions pertaining to Milburn Overlook Redesign and Construction Project (Bid File No. 12501391) (Council District 2):
1. Adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/ Class 1 of the California Environmental Quality Act Guidelines Environmental Assessment No. PC00219, for the Milburn Overlook Redesign and Construction Project;
2. ***RESOLUTION - Adopting the 46th Amendment to the Annual Appropriation Resolution No. 2024-122 appropriating $89,000.00 for the Milburn Overlook Redesign and Construction Project. (Requires 5 Affirmative Votes) (Subject to Mayor’s Veto);
3. Award a construction contract in the amount of $1,262,759.15 for the base bid plus all two (2) Add Alternates to Truxell & Valentino Landscape Development, Inc., of Fresno, California, as the lowest responsive and responsible bidder for the Milburn Overlook Redesign and Construction Project.

RECOMMENDATIONS
Staff recommends that the City Council (1) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PC00219, for the Milburn Overlook Redesign and Construction Project (Project), (2) Adopt the 46th Amendment to the Annual Appropriation Resolution (AAR) No. 2024-122, appropriating $89,000.00 for the Milburn Overlook Redesign and Construction Project, (3) award a construction contract to Truxell & Valentino Landscape Development, Inc., of Fresno, California, in the amount of $1,262,759.15 for the base bid plus all two (2) Add Alternates as the lowest responsive and responsible bidder for the Milburn Overlook Redesign and Construction Project and authorize the Capital Projects Interim Director or designee to sign the Standardized construction contract on behalf of the City.
EXECUTIVE SUMMARY
The Capital Projects Department seeks to award a construction contract to Truxell & Valentino Landscape Development, Inc., following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $1,262,759.15 for the base bid plus all two (2) Add Alternates for the Milburn Overlook Redesign and Construction Project. The Project will remove the existing parking lot infrastructure and install new hardscape, site lighting, irrigation, xeriscape, park benches, picnic tables, waste receptacles, bike racks, educational boards, binoculars, concrete masonry unit (CMU) perimeter wall, perimeter fencing, drinking fountain, steel pergola, steel trellis, accessible on-street parking stall, concrete curb and gutter, pedestrian barricade and other accessibility improvements at the Milburn Overlook, north of Herndon Avenue and Milburn Avenue. Funding for this Project is provided by Measure P allocations adopted in the Fiscal Year 2025 (FY25) Budget. Approval of the 46th Amendment to the AAR will appropriate $89,000.00 to fully fund the construction contract.
BACKGROUND
The City adopted the Clean and Safe Neighborhood Parks Transaction and Use Tax (Measure P) which included funds for improving and maintaining safe, clean neighborhood parks and playgrounds. Pursuant to these goals, the City entered into an agreement with O’Dell Engineering Inc., on May 3, 2023, for design and preparation of the construction documents for the Project. The City of Fresno Park, After School, Recreation and Community Services Department (PARCS) now aims to complete the construction of the Project’s planned improvements including, but not limited to, removal of the existing parking lot infrastructure and installation of new hardscape, site lighting, irrigation, xeriscape, park benches, picnic tables, waste receptacles, bike racks, educational boards, binoculars, concrete masonry unit (CMU) perimeter wall, perimeter fencing, drinking fountain, steel pergola, accessible on-street parking stall, concrete curb and gutter, pedestrian barricade and other accessibility improvements.
A Notice Inviting Bids was advertised and published in the Business Journal, Planet Bids, and posted on the City’s website on January 02, 2025. The Project plans and specifications were distributed to fifty (50) prospective bidders and posted at twelve (12) building exchanges. Five (5) sealed bid proposals were received and opened in a public bid opening on February 19, 2025, with bid amounts ranging from $1,262,759.15 to $1,789,753.00 Truxell & Valentino Landscape Development, Inc., was determined to be the lowest responsive and responsible bidder in the amount of $1,262,759.15 for the base bid plus all two (2) Add Alternates. The bids will expire on Thursday, April 24, 2025. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project.
The contract is covered by the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement to be Bound.
Staff recommends that the City Council adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/ Class 1 of the CEQA Guidelines, Environmental Assessment No. PC00219, adopt the 46th Amendment to the AAR No. 2024-122, appropriating $89,000.00 to fully fund the construction of the Project, and award a construction contract to Truxell & Valentino Landscape Development, Inc., of Fresno, California, in the amount of $1,262,759.15 for the base bid plus all two (2) Add Alternates as the lowest responsive and responsible bidder for the Milburn Overlook Redesign and Construction Project and authorize the Capital Projects Interim Director or designee to sign and execute the standardized construction contract on behalf of the City of Fresno. The construction contact will utilize FY25 Measure P Funding allocations.
The City Attorney’s Office has reviewed and approved all documents as to form.
ENVIRONMENTAL FINDINGS
Staff performed an environmental assessment of this Project and determined that it falls within the Categorical Exemption set forth in CEQA guidelines Section 15301/Class 1 because the proposed project includes only alterations to existing site facilities including ADA improvements, landscaping, site irrigation, and low-impact pedestrian/viewing amenities lighting, and would not expand or include incompatible uses or changes to the existing purpose of the community park site. Therefore, the proposed project would focus on minor site alterations and repairs to the existing site facilities that would involve only negligible expansion of an existing use. Please see the attached Environmental Assessment for more information.
None of the exceptions to categorical exemptions set forth in CEQA Guidelines Section 15300.2 apply to this Project.
LOCAL PREFERENCE
Truxell & Valentino Landscape Development, Inc., is a local business, as defined by the Fresno Municipal Code.
FISCAL IMPACT
The Milburn Overlook Redesign and Construction Project is in Council District 2 and will have no impact to the General Fund. Funding for this Project is provided by Measure P allocations adopted in the FY25 Budget. Adoption of the attached 46th Amendment to the AAR No. 2024-122 will fully fund the construction contract.
